James A. FitzPatrick Nuclear Power Plant (JAFNPP) - ACCEPTANCE OF REQUESTED LICENSING ACTION RE: Request for Exemption from Implementation Date for Part 73 Final Rule for Physical Security Plans. (TAC NO. ME3115)

By letter dated January 21, 2010, Energy Nuclear Operations, Inc., the licensee, submitted the Request for Exemption from Implementation Date for Part 73 Final Rule for Physical Security Plans.

The staff of NRC, the Office of Nuclear Security Incidence Response (NSIR), has reviewed the information provided by Entergy Nuclear Operations Inc. and determined that additional information is needed to complete our review. The request for additional information (RAI) is described below:

REQUEST FOR ADDITIONAL INFORMATION (RAI) FOR JAMES A. FITZPATRICK NUCLEAR POWER PLANT DOCKET NO. 50-333

Reference:

Entergy Exemption Request dated January 21, 2010, Attachment 1, Section C, "Proposed Exemptions."

RAI # 1: Item 2 Note: JAFPs submittal uses identical language when describing the issue which is causing Items 1 and 2 and the solution for each.

Clarification needed: The specific exemption requested for Items 1 and 2 should be the same. The correct requirement for Item 2 is probably the same as was requested for Item 1. Is it possible to combine Items 1 and 2?

RAI # 2: Item 6 The correction for Item 3 will also correct Item 6.

Recommendation: Have the site withdraw this portion of its request.

Reason: This requirement is directly related to Item 3. A separate exemption should not be necessary. The site should be able to meet this requirement under normal circumstances. The fix to Item 3 will fix Item 6, too.
