ORDER EXTENDING THE EFFECTIVENESS OF THE APPROVAL OF THE TRANSFER OF THE FACILITY OPERATING LICENSE RELATING TO ZION NUCLEAR POWER STATION, UNITS 1 AND 2 (TAC NOS. J00341 AND J00342)
Dear Mr. Christian:
The enclosed Order is being issued in response to your request dated January 26, 2010, on behalf of Exelon Generation Company, LLC, and ZionSolutions LLC, for an extension of the effectiveness of the U. S. Nuclear Regulatory Commission's (NRC's) Order of May 4, 2009.
The May 4, 2009, Order approved the transfer of Facility Operating License Nos. DPR-39 and DPR-48, held by Exelon Generation Company LLC, for the Zion Nuclear Power Station, Units 1 and 2, to ZionSolutions LLC, and approved a conforming amendment, pursuant to Title 10 of the Code of Federal Regulations, Sections 50.80 and 50.90.
The NRC staff has considered the information presented in your January 26, 2010, request and has determined that you have shown good cause for extending the effectiveness of the Order of May 4, 2009, to November 4, 2010. The enclosed Order approves the extension. The conforming license amendment will be issued and made effective when the transfer is completed.
The Safety Evaluation enclosed with the May 4, 2009, Order remains valid. This Order is being forwarded to the Office of the Federal Register for publication.
In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter, will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRC=s Agencywide Documents Access and Management System (ADAMS) document system. ADAMS is accessible from the NRC Website at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room).
