Dennis, By letter dated March 16, 2009, Nine Mile Point Nuclear Station, LLC (NMPNS, or the licensee),

submitted for Nuclear Regulatory Commission (NRC) staff review and approval, relief request 1ISI-003, proposed alternative in accordance with paragraph 50.55a(a)(3)(i) of Title 10 of the Code of Federal Regulations and authorization for implementation of a risk-informed/safety based inservice inspection (ISI) program based on the American Society of Mechanical Engineers, Boiler and Pressure Vessel Code Case N-716 for the fourth 10-year ISI interval for Nine Mile Point Nuclear Station, Unit No. 1.

NMPNS responded to the NRC staff's RAI dated August 18, 2009 ML092300025, in its letter dated October 2, 2009. Based on its review of the licensee's responses, the NRC staff needs additional information on RAI No. 2 to complete its review of the relief request mentioned above. The follow-up RAI question is provided below. Please let me know if you'd like to have a phone call to get further clarification(s) on the RAI. As discussed on December 16, 2009, it was agreed that your response would be provided by January 31, 2010.

IF-C8 capability category III is met if no flood sources were screened out based on reliance on operator action to prevent challenges to normal plant operation. The staff interprets screened out (based on the ASME standard definition of screening) to mean that the possible effects of the flood source failure was eliminated from further consideration such that no internal flood scenarios are representative or bounding for the screened source. NMPNS's 9/9/09 response that flood sources from smaller diameter piping were screened out because generally they are lower risk than other, modeled, larger diameter piping does not directly address the screening criteria discussed in IF-C8.

Were any flooding sources screened out based solely on a possible operator action to isolate the flood source before normal plant operation is challenged, and for which there are no included scenarios that would bound the particular affects of the screened source? If so, please describe the scenario including the time available before normal plant operation is challenged, the indications available to the operator, and the procedures directing the operators (pre-challenge) to isolate the flood source.
