RESPONSE TO COMANCHE PEAK DENIAL OF NONCITED VIOLATION IN NRC INTEGRATED INSPECTION REPORT 05000445/446; 2009004

Dear Mr. Flores:

This acknowledges receipt of your letter (CP-200901579) dated, November 23, 2009, in which you disputed noncited violation NCV 05000445/2009004-05; 05000446/2009004-05, "Failure to Assure that One Train of Equipment is Free From Fire Damage." The letter also provided information related to the licensing basis associated with the use of manual actions to achieve a safe shutdown condition following a plant fire. We will review the information you provided when assessing the disputed violation.
