WATTS BAR NUCLEAR PLANT, UNIT 2, OPERATING LICENSE APPLICATION REVIEW - SECTION 106 CONSULTATION

Dear Dr. Garrison:

The U.S. Nuclear Regulatory Commission (NRC) is reviewing an application submitted by the Tennessee Valley Authority (TVA) for an operating license for Watts Bar Nuclear Plant (WBN),

Unit 2, located in Rhea County, Tennessee, at the northern end of the Chickamauga Reservoir, Tennessee River Mile 528.

In a letter dated September 10, 2009, NRC notified the Tennessee Historical Commission that the NRC intends to use the National Environmental Policy Act process for Section 106 purposes, in accordance with 36 CFR § 800.8(c).

As part of the NRC staffs independent environmental review, the NRC staff met with the Tennessee Historical Commission on October 8, 2009, to discuss the proposed action, known issues, and the path forward for completing the Section 106 process for the NRC. TVA completed the Section 106 process and consultation with the Tennessee Historical Commission. The Tennessee Historical Commission submitted a letter to TVA dated January 4, 2007, as evidence of compliance with Section 106. The Tennessee Historical Commission concurred that there are no National Register of Historic Places listed or eligible properties affected by this undertaking.

As discussed in our meeting on October 8, 2009, and as you requested, we are requesting a letter of determination from the Tennessee Historical Commission for the NRC operating license action for WBN, Unit 2, to satisfy NRC compliance with Section 106 of the National Historic Preservation Act (16 U.S.C. § 470f).
