ASSESSMENT FOLLOW-UP LETTER - BRUNSWICK STEAM ELECTRIC PLANT-UNITS 1 AND 2

Dear Mr. Waldrep:

On October 30, 2009, the NRC staff completed a quarterly review of Brunswick Steam Electric Plant. The assessment evaluated performance indicators (PIs) and inspection results. The purpose of this letter is to inform you of your safety performance during this period and our plans for a future inspection at your facility. This letter supplements, but does not supersede, our mid-cycle review letter issued on September 1, 2009.

On June 17, 2009, the NRC issued you a preliminary White finding (Apparent Violation 05000325,324/2009009-01) involving a failure to correctly designate termination points for linking control power to the emergency diesel generator (EDG) lockout relay reset circuitry during the implementation of a design change, which resulted in a loss of EDG local control function. After considering the information developed during the inspection and information provided by Carolina Power and Light Company (CP&L) during and after the regulatory conference, the NRC concluded that the inspection finding was appropriately characterized as White, a finding with low to moderate increased importance to safety. Subsequently, on September 14, 2009, the NRC characterized Apparent Violation 05000325,324/2009009-01 as Violation 05000325,324/2009010-001, Inability to Operate the EDGs Locally as Required by the Safe Shutdown Analysis Report. As a result, we have assessed Brunswick Units 1 and 2 performance to be in the Regulatory Response column of the NRCs Action Matrix due to the White inspection finding for the alternate safe shutdown function related to the emergency diesel generators. Therefore, in addition to the reactor oversight process (ROP) baseline inspection program, the NRC plans to conduct a supplemental inspection in accordance with Inspection Procedure 95001, Inspection for One or Two White Inputs In A Strategic Performance Area, when your staff notifies us of your readiness for this inspection.

We have received your letter dated October 13, 2009, which requested an appeal of the final significance determination of violation 05000325,324/2009010-01. We are currently reviewing the merits of your appeal. Upon completion of our review, we will provide you a letter detailing those results. If we determine that the significance of the violation should be recharacterized, we will reassess Brunswick Units 1 and 2 performance as it relates to the NRCs Action Matrix.
