REPLY TO DUKE ENERGY CAROLINAS, LLC LETTER DATED OCTOBER 1,

2009, REGARDING REVISION TO COMMITMENT IN RESPONSE TO NOTICE

OF VIOLATION EA-08-220 (NRC INSPECTION REPORT NOS.

05000369/2008009 AND 05000370/2008009)

Dear Mr. Hamilton:

This is in response to your letter of October 1, 2009, related to a revision to a commitment in

response to Notice of Violation EA-08-220.

On October 27, 2008, the United States Nuclear Regulatory Commission (NRC) issued McGuire

Nuclear Station a White finding and associated Notice of Violation (NOV) for a failure to correct

a significant condition adverse to quality related to macro-fouling of the Nuclear Service Water

System (NSWS) strainer backwash system. The White finding and NOV were documented in

NRC Inspection Report 05000369/2008009 and 05000370/2008009.

In the Duke Energy Carolinas (DEC) response to the White finding and NOV dated

November 25, 2008, DEC committed to address the NSWS non-conformance by updating the

UFSAR by April 30, 2009, to incorporate the physical and procedural changes that have been

made to the facility as a result of the event; and by submitting a License Amendment Request

(LAR) to resolve the non-conforming condition prior to the conclusion of the fall 2009 refueling

outage.

On October 1, 2009, DEC provided a letter that replaced the commitment to submit a LAR prior

to the conclusion of the fall 2009 refueling outage with a new commitment to enhance portions

of the backwash function of the Nuclear Service Water System. This included physical

modifications to the NSWS and determining if a LAR was necessary. The completion date for

this new commitment was listed as December 2012.

So that we can fully assess the regulatory and safety implications of this new commitment,

please provide a supplemental response within 30 days of the date of this letter that addresses

the following:

1. Provide an explanation addressing what compensatory or other measures you have in place

to assure the operability of the NSWS in case macro-fouling does occur before full

compliance is restored, and why you believe those measures are adequate.

2. Provide a discussion of why your activities will not be completed until December 2012.

Regarding those activities necessary to restore compliance, please specifically address why

the revised date represents the first available opportunity to restore compliance.

In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter, its

enclosure, and your response (if any) will be available electronically for public inspection in the

NRC Public Document Room or from the Publicly Available Records (PARS) component of

NRCs document system (ADAMS). ADAMS is accessible from the NRC Website at
