AEROTEST OPERATIONS, INC. U. S. NUCLEAR REGULATORY COMMISSION RESPONSE TO REQUEST FOR THIRD EXTENSION OF TIME TO REQUEST HEARING ON PROPOSED DENIAL OF LICENSE RENEWAL FOR FACILITY OPERATING LICENSE NO. R-98 (TAC NO. ME1887)
Dear Mr. Brisighella:
By letter dated November 2, 2009, to the U.S. Nuclear Regulatory Commission (NRC), Aerotest Operations, Inc., (Aerotest) requested that the NRC extend the deadline by which Aerotest may request a hearing in response to the proposed denial of the renewal of the Aerotest Radiography and Research Reactor (ARRR) facility operating license. The November 2, 2009, letter states that 60 days is expected to provide time for the Parties for commercial negotiations for the potential sale of the ARRR, and to engage in further discussions with one of your ultimate customers for the services of the ARRR.
The NRC staff has reviewed your request and hereby grants an additional 60-day extension, until January 8, 2010, with the understanding that on or before that date, a license transfer application will be submitted requesting a transfer of Aerotest ownership to a qualified Party.
