AEROTEST OPERATIONS, INC. - NRC RESPONSE TO REQUEST FOR SECOND EXTENSION OF TIME TO REQUEST HEARING ON PROPOSED DENIAL OF LICENSE RENEWAL FOR FACILITY OPERATING LICENSE NO. R-98 (TAC NO. ME1887)
Dear Mr. Brisighella:
By letter dated September 4, 2009, to the U.S. Nuclear Regulatory Commission (NRC), Aerotest Operations, Inc. (Aerotest) requested that the NRC extend by an additional 60 days the deadline by which Aerotest may request a hearing in response to the proposed denial of the renewal of the Aerotest Radiography and Research Reactor (ARRR) Facility Operating License R-98. The July 9, 2009, proposed denial provided that a request for hearing must be submitted by July 29, 2009. An extension was granted extending the deadline until September 8, 2009.
The NRC staff has evaluated the current request and hereby grants an additional 60-day extension until November 9, 2009.
A request for hearing should be submitted, in writing, to the Secretary, Nuclear Regulatory Commission, Washington, DC 20555-0001, Attention: Rulemakings and Adjudications Staff, with a copy to the Associate General Counsel for Hearings, Enforcement, and Administration, Office of the General Counsel, at the same address. Refer to Title 10 of the Code of Federal Regulations 2.302, Filing of documents, for additional filing options and instructions.
