WATERFORD STEAM ELECTRIC STATION, UNIT 3 - CORRECTION TO ELECTRONIC VERSION OF AMENDMENT NO. 218 RE: MODIFICATIONS REQUIREMENTS REGARDING CONTROL ROOM ENVELOPE HABITABILITY (TAC NO. MD6547)

Dear Sir or Madam:

On February 20, 2009 (Agencywide Documents Access and Management System (ADAMS)

Accession No. ML090360713), the U.S. Nuclear Regulatory Commission (NRC) issued Amendment No. 218 to Facility Operating License No. NPF-38 for the Waterford Steam Electric Station, Unit 3 (Waterford 3). The amendment consisted of changes to the Facility Operating License (FOL) and the Technical Specifications (TSs) in response to your application dated August 16, 2007 (ADAMS Accession No. ML072320066), as supplemented by letter dated January 8, 2009 (ADAMS Accession No. ML090120460).

The amendment added a new license condition to FOL NPF-38 on the control room envelope (CRE) habitability program; revised the TS requirements related to the CRE habitability in TS 3.7.6, "Control Room Emergency Air Filtration System - Operating," TS 3.7.6.2, "Control Room Emergency Air Filtration System - Shutdown," and TS 3.7.6.5, "Control Room Isolation and Pressurization"; and established a CRE habitability program in TS Section 6.5, "Administrative Controls - Programs." These changes are consistent with the NRC-approved IndustrylTS Task Force (TSTF) Traveler TSTF-448, Revision 3, "Control Room Habitability."

- 2 Due to an administrative error, page 2 of the amendment letter was missing from the electronic version of the amendment issued on February 20, 2009. The omission does not change the NRC staff conclusions regarding Amendment No. 218 for Waterford 3. Enclosed is a copy of page 2 to the Waterford 3 amendment letter for Amendment No. 218; please add it to your copy of the amendment issued on February 20, 2009.

Accordingly, the license is amended by changes to the Technical Specifications as indicated in the attachment to this license amendment, and Paragraphs 2.C.2 and 2.C.19 of Facility Operating License No. NPF-38 are hereby amended to read as follows:

Technical Specifications and Environmental Protection Plan The Technical Specifications contained in Appendix A, as revised through Amendment No. 218, and the Environmental Protection Plan contained in Appendix S, are hereby incorporated in the license. EOI shall operate the facility in accordance with the Technical Specifications and the Environmental Protection Plan.

Control Room Envelope Habitability Program Upon implementation of Amendment No. 218 adopting TSTF-448, Revision 3, the determination of control room envelope (CRE) unfiltered air inleakage as required by SR 6.5.17, in accordance with TS 6.5.17.c.(i), the assessment of CRE habitability as required by Specification 6.5.17.c.(ii), and the measurement of CRE pressure as required by Specification 6.5.17.d, shall be considered met. Following implementation:

(a)

The first performance of SR 6.5.17, in accordance with Specification 6.5.17.c.(i), shall be within the specified Frequency of 6 years, plus the 18-month allowance of SR 4.0.2, as measured from April 17, 2004, the date of the most recent successful tracer gas test, as stated in the October 8, 2004 letter response to Generic Letter 2003-01, or within the next 18 months if the time period since the most recent successful tracer gas test is greater than 6 years.

(b)

The first performance of the periodic assessment of CRE habitability, Specification 6.5.17.c.(ii), shall be within 3 years, plus the 9-month allowance of SR 4.0.2, as measured from April 17, 2004, the date of the most recent successful tracer gas test, as stated in the October 8, 2004 letter response to Generic Letter 2003-01, or within the next 9 months if the time period since the most recent successful tracer gas test is greater than 3 years.

(c)

The first performance of the periodic measurement of CRE pressure, Specification 6.5.17.d, shall be within 18 months, plus the 138 days allowed by SR 4.0.2, as measured from August 13, 2008, the date of the most recent successful pressure measurement test, or within 138 days if not performed previously.
