UNITED STATES ATOMIC ENERGY COMMISSION WASHINGTON, D.C.

20545 MAR 12 1971 Files KERR MCGEE CORPORATION -

REQUEST FOR WITHHOLDING FROM PUBLIC DISCLOSURE, DOCKET NO.70-925 In conjunction with its application dated February 16, 1971, for amend-ment of Special Nuclear Material License No.

SNM-928, Kerr-McGee Corpo-ration submitted Drawings NPD-206-215 and NPD-206-218 with a request that the drawings be withheld from public disclosure pursuant to Section 2.790 of 10 CFR Part 2.

The drawings referenced above are equipment layout drawings of portions of the Kerr-McGee Cimarron Uranium Plant.

In support of its request for withholding, Kerr-McGee has referenced previous determinations by the Commission on Kerr-McGee plant layout drawings of the same nature.

In requesting wvithholding of previous drawings, Kerr-McGee stated: "This drawing discloses plant layout, process and equipment details and number of process units.

The drawing provides information on processing capa-bility of value to our c6mpetitors.

It is respectfully submitted that the disclosure of this drawing would adversely affect the interest of Kerr-McGee Corporation and is not required in the public interest."

(See memorandum from J. A. McBride, then Director of Division of Mate-rials Licensing, to files dated February 12, 1969, Docket 70-925).

On this basis, the Commission has previously withheld from public disclo-sure Kerr-McGee plant layout Drawings Nos. NPD-107-201 (Rev.

1) and NPD-222, Revisions 1 through 10.

I have determined that the contents of Drawings Nos. NPD-206-215 and NPD-206-218, submitted with the'Kerr-McGee application dated February 16, 1971, are not significantly different in nature from those in earlier drawings which have been previously withheld from public inspection.

Accordingly, I have determined that inspection of Drawings Nos.

NPD-206-.

215 and NPD-206-218 is not required in the public interest nor by 10 CFR Part 9 and would adversely affect the interest of the licensee, and that these drawings should be withheld from public inspection pursuant to 10 CFR Part 2.790(b).
