MID-CYCLE PERFORMANCE REVIEW AND INSPECTION PLAN -
INDIAN POINT NUCLEAR GENERATING UNITS 2 AND 3
Dear Mr. Pollock:
On August 12, 2009, the NRC staff completed its performance reviews of Indian Point Nuclear Generating Units 2 and 3 for the first half of the calendar year 2009 assessment cycle. Our technical staff reviewed performance indicators (PIs) for the most recent quarter and inspection results for the period from July 1, 2008 through June 30, 2009. The purpose of this letter is to inform you of our assessment of your safety performance during this period and our plans for future inspections at your facility.
This performance review and enclosed inspection plan do not include security information. A separate letter designated and marked as, Official Use Only--Security Information, will include the security cornerstone review and resultant inspection plan.
Plant performance for the most recent quarter at Indian Point Nuclear Generating Units 2 and 3 was within the Licensee Response column of the NRCs Action Matrix based on all inspection findings being classified as having very low safety significance (Green) and all performance indicators indicating performance at a level requiring no additional oversight (Green).
Therefore, we plan to conduct reactor oversight process (ROP) baseline inspections at Units 2 and 3.
Subsequent to completion of our August 12 mid-cycle performance review, Indian Point Unit 3 had an unplanned reactor trip on August 27. In accordance with the ROP, we expect that you will evaluate this unplanned trip as part of your 3rd Quarter 2009 PI data submittal to the NRC in October 2009. If this unplanned trip results in the Unplanned Scrams per 7000 Critical Hours NRC PI exceeding the Green/White threshold, the NRC will assess the results at that time and determine appropriate agency action in accordance with the NRCs Action Matrix.
In our annual assessment letter dated March 4, 2009 [ADAMS Ref. ML090620503]1, we advised you of a cross-cutting theme at Indian Point Unit 3 in the area of human performance related to the aspect of human error prevention techniques (H.4(a))2. Based on our review of your performance the previous six months, your actions appear to be appropriate and have resulted in no new findings at Indian Point Unit 3 with the cross-cutting aspect of H.4(a).

Therefore, in accordance with Inspection Manual Chapter 0305, Operating Reactor Assessment Program, the cross-cutting theme at Indian Point Unit 3 no longer exists because there are only three NRC inspection findings for the previous 12-month assessment period with cross-cutting aspects in H.4(a).
During this assessment period, the NRC staff continued augmented oversight of your activities related to on-site groundwater contamination in accordance with the ROP Deviation Memorandum in effect for calendar year 2009 [ADAMS Ref. ML083590057]. Subsequent to this assessment period, during the week of August 17, 2009, the staff conducted an onsite inspection to review your activities associated with characterization and mitigation of onsite groundwater contamination. The results of our reviews are being finalized at this time. The NRC staff will document the inspection results in a forthcoming publicly available report. Based on the results of our inspection and groundwater split sample data, we expect to determine during our end-of-cycle deliberations whether continued enhanced oversight of your actions associated with on-site groundwater contamination is warranted for calendar year 2010.
In addition to the baseline inspection program at Units 2 and 3, we plan to conduct independent spent fuel storage installation inspections. With regard to the replacement Alert and Notification System, the NRC plans to continue to monitor your activities related to final review and approval from the Federal Emergency Management Agency.
The enclosed inspection plan details the baseline and deviation memorandum inspections, less those related to physical protection, scheduled through December 31, 2010. The inspection plan is provided to allow for the resolution of any scheduling conflicts and personnel availability issues well in advance of inspector arrival onsite. Routine resident inspections are not listed due to their ongoing and continuous nature. The inspections in the last nine months of the inspection plan are tentative and may be revised based on our end-of-cycle review.
In accordance with 10 CFR 2.390 of the NRCs Rules of Practice, a copy of this letter and its enclosure will be made available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS). ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room).
As you may know, the NRC is currently evaluating the scope and frequency of all the baseline inspection procedures as part of our biennial review of the ROP. If the results of the evaluation, or any other circumstances, cause us to change the inspection plan, we will contact you to discuss the change as soon as possible.
