DRAFT SAFETY EVALUATION FOR LICENSE AMENDMENT REQUEST MODIFY TECHNICAL SPECIFICATION (TS) 5.6, "FUEL STORAGE," AND ADD NEW TS 3/49.12, "SPENT FUEL POOL (SFP) BORON CONCENTRATION" AND TS 3/49.13, "SPENT FUEL POOL" (TAC NO. MD9685)
Dear Sir or Madam:
By letter dated September 17, 2008, as supplemented by letters dated February 26 and June 30,2009, Entergy Operations, Inc. (the licensee), submitted an application to the U.S.
Nuclear Regulatory Commission (NRC) requesting an amendment to the license in the form of changes to the Technical Specification to take credit for soluble boron in Region 1 (cask storage pit) and Region 2 (spent fuel pool and refueling canal) fuel storage racks for the storage of both Standard and Next Generation Fuel assemblies. Enclosed for review and comment is a copy of the NRC staffs draft safety evaluation (SE) for the license amendment request.
Pursuant to Section 2.390 of Title 10 of the Code of Federal Regulations (10 CFR), we have determined that the enclosed draft non-proprietary SE does not contain proprietary information.
However, we are providing the SE to you at this time, for review, to assure that any information that Holtec International claims to be proprietary would not be inadvertently released to the general public. We will delay placing the SE in the public document room for a period of 10 working days from the date of this letter to provide you with the opportunity to comment on the proprietary aspects. If you believe that any information in the enclosure is proprietary, please identify such information line-by-Iine and define the basis pursuant to the criteria of 10 CFR 2.390. After 10 working days, the SE will be made publicly available. Our conclusions concerning the proprietary nature of your September 17, 2008, and June 30, 2009, submittals, are contained in our letters to Entergy dated November 17, 2008, and July 23, 2009, respectively.
To facilitate the NRC staff's review of your comments, please provide a marked-up copy of the SE showing proposed changes and provide a summary table of the proposed changes.
The Enclosure contains Proprietary Information. Upon separation from the Enclosure. this letter is decontrolled.
