Purpose:

To discuss Oyster Creek license renewal issues and status.

Obiective: To ensure alignment on staff intended actions prior to potential license renewal and period of extended operation for Oyster Creek Schedule Status: Applied for license renewal July 2005. 30-month milestone for issuing a renewed license (with a hearing) was January 22, 2008. Currently, 11 months beyond the 30-month review milestone. Current operating license expires on April 9, 2009.

Hearingi Status:

Issues: ASLB admitted contention on drywell UT testing (10/10/06)

Hearing: Oct. 24-25, 2007 with decision on Dec. 18, 2007 to reject challenge Appeal: Jan. 14, 2008 with decision on October 29, 2008 (see ASLB Decision below)

ASLB Decision The Board issued its decision regarding the appeal and found in favor of the applicant with the following recommendations:

Applicant should reconsider the size of regions considered in drywell shell model Commission should consider directing the staff to have Sandia review the test results Applicant should perform a sensitivity study Applicant should further reduce the thickness of the drywell shell used in the analysis Applicant should not limit the second sensitivity study to just Bay 19 Staff should perform a rigorous review of the structural analysis The Commission has not yet made their decision on the appeal or the ASLB's decision SECY paper (b)(5)

Period of Extended Operation The staff granted Oyster Creek and exemption from the requirement of timely request for license renewal (less than 5 years before expiration of current license)

The exemption allows the licensee to operate into the period of extended operation if a renewed license has not been issued if they meet the following conditions:

o licensee submit the application before July 29, 2005

'LR, DORL, OGC, and Region I staff are discussing path forward into the period of extended operation (Communication Plan, inspections, etc.)
