Richard Conte, F-1 Friday, January 09, 2009 9:40 AM Mary Baty; David Pelton; Marsha Gamberoni; Ronald Bellamy; Nancy McNamara Nancy McNamara; Edward Williamson; Brian Holian; Lisa Regner; Samson Lee; Darrell Roberts CONF. AT 1000 AM FRIDAY ON NJ CONCERNS For Addressees, Regon I will call Dave Pelton's office at 1000am.

We conferenced with state representatives from New Jersey about their concern that the public (this includes parties, and Commission on OC renewal hearing decision in appeal) do not have details on the 71003 inspection results. I and Dr. Lipoti discussed in a highlight way a number of details not in the public domain -

there was general agreement on issues in the public domain and details NOT the public domain. She then made the following points:

1) It is important for the public to have the details before any decision is made.
2) For the current situation, the staff appears to be covering up those details until Feb. 6-7 the announced 45 days for the report to come out.
3) NJ has been monitoring the Commission schedule and if the decision appears as an affirmative action vote related on the matter, they will be forced to act (no details given).

We assured her that we were moving up the scheduled issue date for the report and that we would get back to her on next steps and process. We exchanged pleasantries and said goodbye. Then we briefed Sam Collins.

We decided to pursue some process questions and explore some options.
