Dear Mr. Spano:

On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your May 19, 2009, letter addressed to Chairman Gregory B. Jaczko. In your letter, you requested that the agency move its June 15, 2009, meeting with Entergy Nuclear Operations, Inc., from NRC Headquarters in Rockville, MD, to Westchester County, NY. As you know, Entergy is the licensee for Indian Point Nuclear Generating Unit Nos. 2 and 3 (IP2 and IP3), which are located in Westchester County.

Although portions of this meeting are open to the public to observe, the purpose of this meeting is for Entergy to present to the NRC staff proposed plans to transfer IP3 spent fuel to the IP2 spent fuel pool, and from there into dry cask storage at the independent spent fuel installation that already exists at the site. Entergy has indicated that it will need license amendments approved by the staff before it can conduct this activity, and will submit the license amendment requests at a later time. The agency selected the Rockville location because a large number of NRC staff must participate in this meeting in order to understand the proposals and the licensing activities the licensee will be requesting.

The NRC considers public involvement in, and information about, our activities to be a cornerstone of strong, open regulation of the nuclear industry. We recognize the public's interest in the proper regulation of nuclear activities and provide opportunities for citizens to be heard. As you noted in your letter, many other parties are also interested in the discussion.

Therefore, the NRC will make this meeting available to the public at our Rockville location and also through a listen-only telephone conference and a Webcast accessible from the NRC's Web site at http://www.nrc.gov. The NRC will also provide a telephone number for members of the public to call to ask questions during the public question portion of the meeting. This information has been published in the NRC's meeting notice, which is enclosed. I trust that this is responsive to your request for enhanc.ed public access to this meeting.
