This request, described in the attachment to this letter, applies to the NMP1 fourth ten-year ISI interval and to the NMP2 third ten-year ISI interval. The NMP1 and NMP2 ISI program updates and associated 10 CFR 50.55a requests were previously submitted to the NRC in References (a) and (b), respectively.

NMPNS requests approval of this request by December 31, 2009 to support planning activities for the next NMP2 refueling outage, which is currently scheduled for spring 2010.

This letter does not contain any regulatory commitments.

NINE MILE POINT NUCLEAR STATION, UNITS 1 AND 2 REQUEST IN ACCORDANCE WITH 10 CFR 50.55a(g)(4)(iv) FOR USE OF A LATER CODE EDITION AND ADDENDA FOR THE INSERVICE INSPECTION PROGRAMS A.

ASME CODE COMPONENTS AFFECTED This request affects all applicable components, component supports, and welds included within the scope of the American Society of Mechanical Engineers (ASME)Section XI inservice inspection (ISI) programs for Nine Mile Point Unit 1 (NMP1) and Unit 2 (NMP2). The NMP1 and NMP2 ISI program updates and associated 10 CFR 50.55a requests were previously submitted to the NRC in References 1 and 2, respectively.

B.

APPLICABLE CODE EDITION AND ADDENDA NMP I: The applicable code for the fourth ten-year ISI interval is currently the 2001 Edition with 2003 Addenda of ASME Section XI.

NMP2: The applicable code for the third ten-year ISI interval is currently the 2001 Edition with 2003 Addenda of ASME Section XI.

PROPOSED SUBSEQUENT CODE EDITION AND ADDENDA Pursuant to 10 CFR 50.55a(g)(4)(iv), Nine Mile Point Nuclear Station, LLC (NMPNS) requests NRC approval to use the 2004 Edition (no Addenda) of ASME Section XI as the code of record for the NMP 1 fourth ten-year ISI interval and for the NMP2 third ten-year ISI interval.

As required by 10 CFR 50.55a(g)(4)(ii), the ISI program for each ten-year interval must comply with the requirements in the latest edition and addenda of Section XI of the ASME Code incorporated by reference in 10 CFR 50.55a(b) 12 months prior to the start of the interval. Based on the scheduled start dates for the ISI intervals (August 23, 2009 for the NMP1 fourth ten-year ISI interval and April 5, 2008 for the NMP2 third ten-year ISI interval), the applicable code for both NMP1 and NMP2 was the 2001 Edition with 2003 Addenda. The NRC subsequently amended 10 CFR 50.55a(b) on September 10, 2008 (73 FR 52730) to incorporate by reference the 2004 Edition (no Addenda) of ASME Section XI, Division 1. NMP1 and NMP2 are part of the Constellation Energy fleet of nuclear power plants. Submittal of this request is consistent with Constellation's goal of standardizing the ASME Code requirements applicable to the ISI programs for the fleet nuclear power plants.

For NMP1, NMPNS has previously submitted three 10 CFR 50.55a requests associated with the ISI program that are presently under review by the NRC. Request number 1ISI-001A was submitted by NMPNS letter dated September 16, 2008 (Reference 3), request number 1ISI-02 was submitted by NMPNS letter dated August 29, 2008 (Reference 4), and request number 1ISI-003 was submitted by NMPNS letter dated March 16, 2009 (Reference 1). These three 10 CFR 50.55a requests are unaffected by this request to use the 2004 Edition (no Addenda) of ASME Section XI (other than the Code edition referenced in the 10 CFR 50.55a requests).

For NMP2, the NRC has previously authorized three 10 CFR 50.55a requests associated with the ISI program. NMPNS request number 21SI-001A was approved by NRC letter dated November 5, 2007 (Reference 5) for use through the end of the NMP2 license renewal extended period of operation. NMPNS request numbers 21SI-007 and 2ISI-009 were approved by NRC letter dated December 1, 2008 (Reference 6) for use during the third ten-year ISI interval. These three NRC-approved requests are unaffected by this request to use the 2004 Edition (no Addenda) of ASME 1 of 3

RELATED REQUIREMENTS NMPNS is requesting NRC approval to use the 2004 Edition (no Addenda) of ASME Section XI in its entirety for the NMP1 and NMP2 ISI programs, including applicable modifications and limitations listed in 10 CFR 50.55a(b). Thus, all related code requirements will be met.

DURATION OF PROPOSED REQUEST NMPI: The fourth ten-year ISI interval is scheduled to begin on August 23, 2009 and end on August 22, 2019.

NMP2: The third ten-year ISI interval began on April 5, 2008 and is scheduled to end on April 4, 2018.

The duration of this request is from implementation following NRC approval of this request until the end of the fourth ten-year ISI interval for NMP1 and until the end of the third ten-year ISI interval for NMP2.
