RE Pilgrim NPS RFO 2009: 2.206 Petition Requesting that NRC Require All Work Packages Inspected Prior to Pilgrim's Re-Start -Urgent Action Requested Due to Timing Re-Start First congratulations on your appointment as Chair of the Commission and we look forward to working with you in the future on shared public safety concerns.

As you know Duxbury, Massachusetts is within the Pilgrim Nuclear Power Station's Emergency Planning Zone. Duxbury is approximately 6 miles across open water from the reactor. Therefore, safety at Pilgrim NPS is a primary concern due to its potential direct impact upon our family's health, property and community. Members of Pilgrim Watch and the Town of Duxbury Nuclear Advisory Committee live within the Emergency Planning Zone and are likewise impacted.

We request that this correspondence be regarded, and treated as a 2.206 petition.

Summary Reactor: Pilgrim Nuclear Power Station, Plymouth, Massachusetts Request for Enforcement Action: During the on-going re-fueling outage 2009, we were informed of a leak out of the packaging gland of the condensate pump; because this is a QA issue, we request the Commission request inspection of all work packages prior to

allowing re-start. Due to the fact that re-start is scheduled to occur very soon, we request urgent action on this petition.

Facts that constitute the basis for taking this action: discussed herein.

Discussion We are filing a 2.206 petition on behalf of Pilgrim Watch and the Town of Duxbury Nuclear Advisory Committee as the only means available to address safety concerns.

Issue: We understand that during the refueling outage at Pilgrim NPS, Operations started putting water into the condenser hotwell from the reactor vessel cavity; and when the water went into the hotwell it started to leak out of the packing gland of the condensate pump. We reported this to Donald Jackson, Branch Chief Region I and to Mel Gray via email on May 13, 2009 and spoke with Mel Gray about this on May 14 and May 15.

It is being treated as an allegation.

Description:==

The job was to pack the gland of the condensate pump. The job was not done but was signed off as completed. After it was signed off, the schedule called for Operations to lower the reactor vessel water level so they could start to re-assemble the vessel for startup. The water was drained to the condenser hotwell. Once the hotwell started to fill, the water then leaked from the packing gland .of the condensate pump.

At some later time an operator found the leak and the leak was stopped. It is unknown how much water leaked onto the floor around the pump. That water would have been contaminated since it had been in contact with the reactor and the fuel during fuel movement. PNPS and NRC should have an idea about the amount of water spilled by checking with radwaste. We understand that the sumps have counters that will tell how much water has been pumped from the turbine building sump to the radwaste holding tanks.

This event was not reported as an Event Report on NRC's webpage. It should be reported as an error and a spill.

It is clear to us that the event represents a QA breakdown; therefore, we requested in our email to Don Jackson and Mel Gray that NRC require that the outage be extended until all work packages are re-inspected. We are following with a formal 2.206 making the same request directly to the Commission.

Mel Gray informed Mary Lampert that they will look into the allegation to assure that our description of it is factually correct. However, timing is important because we would not want to risk Pilgrim having already re-started prior to NRC completing its investigation -

analogous to the horse would have left the barn prior to fixing the barn door. Clearly the same goes for timing in the Commission's response to this 2.206. Therefore, we request urgent action on this Petition.

Further, this is not the only QA problem that we are aware during this outage. For example, there was a fuel handling problem resulting in bending the fuel mast and foreign material found in the spent fuel pool.

In order to preserve public safety and public confidence in NRC's ability and willingness to regulate to preserve public safety, we request in this petition that Pilgrim Nuclear Power Station not be allowed to restart until all work packages are re-examined to assure that other QA issues are discovered and addressed.
