In order to implement the requirements of the Energy Policy Act of 2005 (EPAct), the NRC has published an Advance Notice of Proposed Rulemaking (ANPR) [74 FR 17115, April 14, 2009] to solicit the views of interested parties before commencing with the formal rulemaking process. Specific areas upon which the Commission is requesting public comments have been provided in the Federal Register notice announcing the ANPR.

The NRC is also seeking stakeholder comments on how the NRC could prepare requirements that would incorporate a risk informed and graded approach; consider the types of special nuclear material and other sensitive materials; and consider the research and test reactors licensed power level.
