TURKEY POINT UNITS 3 AND 4 - REQUEST FOR INFORMATION REGARDING MR. THOMAS SAPORITO'S JANUARY 11, 2009, 2.206 PETITION (TAC NOS. ME0759 AND ME0760)

Dear Mr. Blair:

On March 19, 2008, a public teleconference was held regarding a request submitted by Thomas Saporito, dated January 11, 2009, to the U.S. Nuclear Regulatory Commission (NRC),

pursuant to Title 10, Code of Federal Regulations, Section 2.206. You participated as a representative of the licensee in question, Florida Power & Light Company (FPL). I participated as Chairman of the NRC Petition Review Board (PRB).

During the conference, Jenny Longo, a senior attorney from the NRC Office of the General Counsel, requested that FPL supply to the NRC PRB a blank, unsigned copy of the bonus agreement form used by FPL. The requested form was the one referred to in an article by John Dorschner in the Miami Herald online edition of March 12, 2009. Mr. Dorschner stated in the article that the bonus agreement contains a clause to the effect that "the employee shall not, at any time in the future and in any way... make any statements that may be derogatory or detrimental to the company's good name." Mr. Saporito submitted a copy of the Miami Herald article in support of his January 11, 2009, petition request concerning, among other things, the Safety Conscious Work Environment at FPL. You confirmed that a bonus agreement form exists, but requested that NRC submit a request to you in writing in order to obtain the form.

Pursuant to Section 161c. of the Atomic Energy Act of 1954, as amended, 42 USC 2201(c), the NRC is authorized to obtain such information as it deems necessary and proper to assist it in exercising any authority provided in the Atomic Energy Act, or in the administration or enforcement of the Atomic Energy Act or of any regulations issued thereunder.

In order to proceed with the review of Mr. Saporito's January 11, 2009, petition request, the NRC staff requires a blank copy of the described bonus agreement form.
