PEACH BOTTOM ATOMIC POWER STATION, UNITS 2 AND 3 - REQUEST FOR ADDITIONAL INFORMATION REGARDING LICENSE AMENDMENT REQUEST TO IMPLEMENT TSTF-363-A, REVISION a (TAC NOS. MD9434 AND MD9435)

Dear Mr. Pardee:

By letter to the Nuclear Regulatory Commission (NRC) dated August 7, 2008 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML082240520), Exelon Generation Company, LLC (the licensee), submitted a license amendment request that included a request to implement Technical Specification Task Force (TSTF) Improved Technical Specifications (ITS) TSTF-363-A, Revision 0, "Revise Topical Report references in ITS 5.6.5, COLR [core operating limits report]." The proposed change would revise Technical Specification 5.6.5 to remove the requirement to maintain COLR topical report references by number, title, date, and NRC staff-approved document, if currently included. The change would permit referencing the topical report by number and title with the additional details controlled within the COLR. The NRC staff has reviewed the request submitted by the licensee and has identified a need for additional information as set forth in the Enclosure.

The draft questions were sent to Thomas Loomis, of your staff, to ensure that the questions were understandable, the regulatory basis for the question was clear, and to determine if the information was previously docketed. On April 8, 2009, Mr. Loomis indicated that the licensee will submit a response by May 8, 2009. Please note that if you do not respond to this letter by the agreed-upon date or provide an acceptable alternate date in writing, we may reject your application for amendment under the provisions of Title 10 of the Code of Federal Regulations, Section 2.108.

Section 2.1 of Attachment 1 of the Licensing Amendment Request dated August 7, 2008 (ADAMS Accession No. ML082240520), referring to TSTF-363-A states that:

"There are no intended deviations from the TSTF."

However, the submittal does not include a TSTF-proposed revision to TS 5.6.5 that inserts a note stating that the COLR now contains the complete citation for the reports used.

An NRC letter dated December 15,1999 (ADAMS Accession No. ML993540351), from Stuart A. Richards to James F. Mallay, attached to and incorporated as part of TSTF-363-A states the following:

"The method would allow the references to approved topical reports in the TS to be cited using the report number and title, and a note that the COLR provides the complete citation for the reports used."

Please provide an explanation for the apparent deviation from TSTF-363-A of not including a proposed note in Technical Specification 5.6.5 indicating that the COLR provides the complete citation for the reports used. Please include a technical basis for the deviation.
