SUSQUEHANNA STEAM ELECTRIC STATION, UNITS 1 AND 2 - REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE (TAC NOS. ME0578 AND ME0579)
Dear Mr. Kammeier:
By letter dated March 25, 2009, you submitted an affidavit, dated March 25, 2009, requesting that the information contained in the following document be withheld from public disclosure pursuant to Title 10 of the Code of Federal Regulations (10 CFR) Section 2.390(a)(4) and 10 CFR 9.17(a)(4):
Allegheny Electric Cooperative, Inc. (Allegheny) titled Susquehanna Steam Electric Station Decommissioning Report of Financial Assurance, Docket Nos.
50-387, and 50-388, dated March 25, 2009, Attachment 2.
The affidavit stated that the submitted information should be considered exempt from mandatory public disclosure for the following reasons:

This information has been held in confidence by Allegheny.
ii)
This information is of a type that is held in confidence by Allegheny, and there is a rational basis for doing so because the information contains sensitive financial information.
iii)
This information is being transmitted to the NRC in confidence.
iv)
This information is not available in public sources and could not be gathered readily from other publicly available information.
v)
Public disclosure of this information would cause substantial harm to the competitive position of Allegheny by disclosing Allegheny's internal cost projections to other parties whose commercial interests may be adverse to those of Allegheny.
We have reviewed your application in accordance with the requirements of 10 CFR 2.390(a)( 4) and 10 CFR 9.17(a)( 4), and have concluded that the financial information in your application, sought to be withheld from public disclosure is related to the requirements of 10 CFR 50.75(f)(1),
"Reporting and recordkeeping for decommissioning planning." It does not meet the

- 2 requirements of 10 CFR 2.390(a)(4) and as such, cannot be withheld from public disclosure. In particular, the information presented in Attachment 2 is merely a year-by-year mathematical calculation of the factors presented in your non-proprietary Attachment 1.
Accordingly, we have concluded that the information sought to be withheld from public disclosure does not meet the requirements of 10 CFR 2.390. Therefore, your request to withhold the information sought to be withheld from public disclosure is denied.
Within 30 days from the receipt of this letter, the subject documents will be placed in the U.S.
Nuclear Regulatory Commission's Public Document Room. If, within thirty (30) days of the receipt of this letter, you request withdrawal of the documents in accordance with 10 CFR 2.390(c), your request will be considered in light of applicable statutes and regulations and a determination made whether the documents will be withheld from public disclosure and returned to you.
