REQUEST FOR EXTENSION OF SUBMITTAL OF REACTOR VESSEL MATERIAL SURVEILLANCE CAPSULE REPORT - RE. GINNA NUCLEAR POWER PLANT (TAC NO. ME0984)

Dear Mr. Carlin:

Appendix H to Title 10 of the Code of Federal Regulations (10 CFR), Part 50, "Reactor Vessel Material Surveillance Program Requirements," requires a program to monitor changes in the fracture toughness properties of ferritic materials in the reactor vessel beltline region of light water nuclear power reactors which result from exposure of these materials to neutron irradiation and the thermal environment. Under the program, fracture toughness test data are obtained from material specimens exposed in surveillance capsules, which are withdrawn periodically from the reactor vessel. Paragraph IV.A. of Appendix H states that, "Each capsule withdrawal and the test results must be the subject of a summary technical report to be submitted, as specified in § 50.4, within one year of the date of capsule withdrawal, unless an extension is granted by the Director, Office of Nuclear Reactor Regulation."

By letter dated March 31, 2009, RE. Ginna Nuclear Power Plant, LLC, the licensee, stated that the "N" reactor vessel material surveillance capsule was removed from the reactor vessel on April 27, 2008, during the spring 2008 refueling outage. Accordingly, the reporting requirements of Appendix H dictate that the summary technical report be submitted no later than April 27, 2009. However, citing a need for additional time for their contractor to complete the associated technical reports, the licensee requested a one-month extension until May 29, 2009, for the submittal of the summary report.

The Nuclear Regulatory Commission staff considers the one-month extension to be consistent with the overall expectation of a one-year reporting requirement. Therefore, your request is hereby granted. Please contact Douglas Pickett at 301-415-1364 if you have any questions.
