TRANSMITTAL OF DEPARTMENT OF HOMELAND SECURITY CONSULTATION REPORT, WATTS BAR NUCLEAR PLANT, UNIT 2
Dear Mr. Glover:
Under Section 657, "Department of Homeland Security Consultation," of the Energy Policy Act of 2005 (PL-109-58), the U.S. Nuclear Regulatory Commission (NRC) is required, before issuing a license for a utilization facility, to consult with the U.S. Department of Homeland Security (DHS) concerning potential vulnerabilities of the location of the proposed facility to terrorist attack. In this regard, an NRC - DHS Memorandum of Understanding (MOU) was executed on February 20, 2007, which states that DHS is to provide the NRC with written comments concerning the potential vulnerabilities.
On June 30,1976, as supplemented on September 27,1976, the Tennessee Valley Authority (TVA) submitted its application for an operating license for Watts Bar Nuclear Plant (WBN),
Unit 2. The NRC found the application acceptable for docketing on September 15, 1976. By letter dated March 4, 2009, TVA provided an update to its original application for the WBN Unit 2 operating license.
A DHS visit to the WBN site in Rhea County, TN, was performed from August 12 to August 14, 2008. On November 7,2008, DHS completed its review and provided the "New Reactor Consultation Report on the Watts Bar Nuclear Generating Station Unit 2" to the NRC.
The Safeguards Information (SGI) portion of the New Reactor Consultation Report is enclosed as Enclosure 1. The consultation report is provided as "for information only." TVA is not required to respond to this correspondence. Further, Enclosure 1 does not include Appendix A, "Homeland Infrastructure Threat and Risk Analysis Center (HITRAC) Threat Assessment Assess In Support of New Reactor Consultation."

- 2 Portions of the enclosed document are designated as SGI and the NRC staff has determined that TVA has a valid "need-to-know" for this information in association with its operating license application. TVA shall handle the SGI enclosure in accordance with the requirements of Section 73.21, "Requirements for the Protection of Safeguards Information," of Part 73 to Title 10 of the Code of Federal Regulations.
