Dear Mr. Meyer:

By letter to the Nuclear Regulatory Commission (NRC) dated July 24,2008 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML082240685), FPL Energy Point Beach, LLC, submitted a request to revise the Technical Specifications 3.7.12 and 4.3.1 to incorporate the results of a new spent fuel pool criticality analysis.

The NRC staff is reviewing your submittal and has determined that additional information is required to complete the review. The specific information requested is addressed in the enclosure to this letter. During a discussion with your staff on March 6, 2009, it was agreed that you would provide the additional information within 30 days of the date of this letter.

The NRC staff considers that timely responses to requests for additional information help ensure sufficient time is available for staff review and contribute toward the NRC's goal of efficient and effective use of staff resources. If circumstances result in the need to revise the requested response date, please contact me at (301) 415-2048.

REQUEST FOR ADDITIONAL INFORMATION SPENT FUEL POOL CRITICALITY CONTROL POINT BEACH NUCLEAR POWER PLANT, UNITS 1 AND 2 DOCKET NOS. 50-266 AND 50-301

1. In the application, the licensee is proposing to no longer credit Boraflex for criticality in Point Beach's Boraflex storage racks. Currently, the licensee is committed to periodic sampling of the Boraflex in the spent fuel pool as stated in their October 23, 1996, response to Generic Letter 96-04, "Boraflex Degradation in the Spent Fuel Pool Storage Racks." However, it is not clear in the submittal whether the licensee is intending to continue the Boraflex Monitoring Program. Please clarify whether the existing Boraflex Monitoring Program will continue to be implemented.
2. If the Boraflex monitoring program will be discontinued as a result of this proposed license amendment request, please explain how Point Beach will be able to identify and mitigate any degradation of the Boraflex that may impede other plant operations.

Examples may include excessive silica levels impacting the spent fuel pool chemistry or an unforeseen damage mechanism to the Boraflex cladding that may impact safe fuel handling.
