McGuire Nuclear Station, Units 1 and 2 Docket Nos. 50-369 and 50-370 Update on the Status of the November 18, 2008 Request for Additional Information (RAI) and Additional Testing for McGuire Units 1 and 2 Pursuant to NRC Generic Letter (GL) 2004-02, "Potential Impact of Debris Blockage on Emergency Recirculation During Design Basis Accidents at Pressurized-Water Reactors" Pursuant to the November 18, 2008 RAI letter, Duke is providing an update on the schedule for the RAI responses. This letter will outline the history of Duke's responses and future plans to resolve reviewer concerns with McGuire's GL 2004-02 Supplemental Responses.

In November of 2007, Duke completed prototype chemical effects testing for the evaluation of Emergency Core Cooling System strainer head loss. The results of this testing were used in the February 28 and April 30, 2008 McGuire supplemental responses to GL 2004-02. In March 2008, a document titled "NRC Staff Review Guidance Regarding Generic Letter 2004-02 Closure in the Area of Strainer Head Loss and Vortexing" was issued. Thus, the lessons learned through industry testing were not available to be fully incorporated into Duke's original testing protocols.

By letter dated November 18, 2008, the NRC forwarded RAIs regarding the McGuire supplemental responses to GL 2004-02. As stated in the letter, the NRC requested a 90 day response for all RAIs with the exception of RAI 31.

On November 24, 2008, a meeting was convened between the NRC and Duke to discuss.staff concerns with Duke's original prototype testing (debris preparation, debris introduction, debris agglomeration, flow fields, bare strainer area and chemical effects).

U. S. Nuclear Regulatory Commission February 16, 2009 Page 2 debris bed head loss testing using test methodology reflecting the more recent guidance. Several of the November 2008 RAI questions were test dependent; therefore, the response to the original RAI may change based on the results of confirmatory debris bed head loss testing.

Duke is currently in the process of vetting vendors' bids for testing planned in the April to July 2009 timeframe. Since a firm testing schedule is not available at this time, Duke proposes an RAI response date for all RAIs (except RAI 31) of fall of 2009. Duke commits to provide a refined date for this RAI response and an update on testing progress by July 31, 2009. The date for response to RAI 31 will be within 90 days of issuance of the final NRC staff's SE on WCAP-16793 or December 31, 2009, whichever is later. Attachment A provides the regulatory commitments made in this letter.
