Acceptance review results for Davis-Besse relief requests submitted by letter dated 1/30/09 By [[letter::L-09-020, 10 CFR 50.55a Requests for Alternative Dissimilar Metal Weld Repair Methods for Reactor Vessel Nozzles, Reactor Coolant Pump Nozzles, and Reactor Coolant Piping|letter dated January 30, 2009]], FirstEnergy Nuclear Operating Company submitted two relief requests for Davis-Besse Nuclear Power Station (DBNPS). The purpose of this letter is to provide the results of the U.S. Nuclear Regulatory Commission (NRC) staffs acceptance review of this relief request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

Pursuant to Sections 50.55a(a)(3)(i) of Title 10 of the Code of Federal Regulations (10 CFR),

the applicant shall demonstrate that the proposed alternatives would provide an acceptable level of quality and safety.

The NRC staff has reviewed your application and concluded that it does provide technical information in sufficient detail to enable the staff to proceed with its detailed technical review of the two relief requests and make independent assessments regarding the acceptability of the proposed requests in terms of regulatory requirements and the protection of the public health and safety and the environment. If additional information is needed for the staff to complete its technical review, you will be advised by separate correspondence.

The NRC staff also notes that the licensee discussed briefly the leak-before-break (LBB) evaluation on page 7 of 11 in RR-A32 Attachment 1. The NRC staff finds that the licensee needs to submit a license amendment request to update the LBB evaluation for DBNPS as soon as possible. The NRC staff approval of the license amendment request may affect the plant restart. As a reference, DBNPS may check a current LBB submittal (ADAMS ML0832903431) from Catawba Unit 2 as part of its weld overlay relief request.
