This letter is being subrhntled pursuant to 40 CFR 61.150 (d)(4) and in accordance with your letter dated July 1, 1994 confirming that Dominion's procedure for tracking low-level radiologically contaminated asbestos waste (RCAW) is acceptable for maintaining compliance with the National Emissions Standards Imr Hazardous Air Pollutants (NESHAP) regulations. This is official notification that Surry Power Station (I) has not received a copy of the waste shipment record (WSR) signed by the owner or operator of the designated waste disposal site within 35 days since the waste was shipped off-site (inquiry requirement time period) and (2) will not receive the WSR within 45 days (notification requirement time period).
On November 13, 2008, RCAW (Shipment 1)2008-12) was shipped from Surry Power Station to Duratek Services' Bear Creek Facility, Kingston, Tennessee. The facility acknowledged receipt on November 1 7. 2008. The waste was scheduled to undergo interim processing at,ear (.reek then shipped to Energy Solution's Clive Disposal site in Clive, Utah for final burial as indicated on the WSR that accompanied the shipment. The signed WSR indicating final disposal was not returned to SIiTy Power Station within 35 days, therefore, a search was initiated to determine the status of the waste shipment.
Prior to the 35.' day after shipment, Surry Power Station contacted l)uratek Services, Inc. and inquired about waste shipment 1D2(008-12. Surry was told that interim processing is taking longer than expected and the waste is still located at the Bear Creek Facility. The RCAW will not be processed until after the 35"' day and it will not be buried at Energy Solutions Clive [)isposal site until after the 4 5"' day, December 28, 2008, as required.
Copies of the written noti fication dated November 17, 2008, from Duratck Serviccs, Inc. to Surry Power Station and the WSR that accompanied Shipment 1)2008-12 are attached for your review.
Once Surry Power Station receives the final waste shipment records, EPA will be notified that the outstanding WSR has been received and closed.

- 2.
On June 14, 1994, Mr. A. W. Hadder issued a letter to Mr. John Daley, NESHAP Asbestos Coordinator for the EPA confirming the agreement to-accept Dominion's procedure for tracking low-level radiologically contaminated asbestos waste (RCAW).
- 3. On July 1. 1994, Mr. John Daley, NESHAP Asbestos Coordinator for the EPA issued a letter to Mr. A. W.; Hadder formally agreeing to Dominion's procedure for tracking low-level radiologically contaminated asbestos waste (RCAW).
- 4. On November 13, 2007, Surry Power Station shipped RCAW for processing and disposal.
- 5. On November 17, 2008, Duratek Services, Inc. issued a letter to the Surry Power Station with an acknowledgement of receipt of shipment D2008-12.
- 6. Prior to December 18, the 35'h day after shipment, Duratek Services, Inc. responded to Surry Power Station's inquiry of the status of the intermediate processing and the expected burial of shipment D2008-12.
Commitments/Action Plan
- 1. EP&C must notify EPA, with a copy to the NRC, that the outstanding waste shipment record (WSR) has been received by the station.
