YANKEE ROWE INDEPENDENT SPENT FUEL STORAGE INSTALLATION SECURITY PLAN CHANGES (L24211)

Dear Mr. Mitchell:

By letter dated April 1, 2008, you submitted a request to the U.S. Nuclear Regulatory Commission (NRC) for an amendment to License No. DPR-3 (Docket No. 50-29) for the Yankee Nuclear Power Station (YNPS). The amendment was requested in conjunction with the proposed changes in Revision 19 to the YNPS physical security plan, which applies to the Independent Spent Fuel Storage Installation (ISFSI) at the site.

The NRC staff reviewed your application and the proposed revisions to the physical security plan, and determined that the proposed changes would not decrease the effectiveness of the plan, as documented in our letter of November 18, 2008 (copy enclosed). Therefore, the staff has concluded that the proposed changes meet the criteria of 10 CFR 50.54(p)(2), and do not require a license amendment, nor prior NRC review and approval. Please note that 10 CFR 50.54(p)(2) requires the licensee to submit a report of the changes made to the security plan within 2 months of implementation. This notification may simply reference your April 1, 2008, submittal, if there are no further changes to the physical security plan.

Dear Mr. Mitchell:

On April 1, 2008, the U.S. Nuclear Regulatory Commission (NRC), Nuclear Security Incident Response, Division of Security Policy, Materials, Waste, and International Security Branch received a copy of Revision number 19 to the Yankee Rowe Physical Security Plan. NRC staff has reviewed the proposed changes to the Yankee Rowe Physical Security Plan and has determined that the identified changes are in compliance with Title 10 of the code of Federal Regulations Part 50.54 (p) (10 CFR 50.54 (p)) as they do not reduce the effectiveness of the security of your site.
