OF TELEPHONE CONFERENCE CALL HELD ON NOVEMBER 17, 2008, BETWEEN THE U.S. NUCLEAR REGULATORY COMMISSION AND FIRSTENERGY NUCLEAR OPERATING COMPANY, CONCERNING REQUESTS FOR ADDITIONAL INFORMATION PERTAINING TO THE BEAVER VALLEY POWER STATION, UNITS 1 AND 2, LICENSE RENEWAL APPLICATION The U.S. Nuclear Regulatory Commission (NRC or the staff) and representatives of FirstEnergy Nuclear Operating Company held a telephone conference call on November 17, 2008, to discuss and clarify the staffs requests for additional information (RAIs) concerning the Beaver Valley Power Station, Units 1 and 2, license renewal application. The telephone conference call was useful in clarifying the intent of the staffs RAIs.

REQUESTS FOR ADDITIONAL INFORMATION BEAVER VALLEY POWER STATION, UNITS 1 AND 2 LICENSE RENEWAL APPLICATION NOVEMBER 17, 2008 The U.S. Nuclear Regulatory Commission (NRC or the staff) and representatives of FirstEnergy Nuclear Operating Company held a telephone conference call on November 17, 2008, to discuss and clarify the following requests for additional information (RAIs) concerning the Beaver Valley Power Station (BVPS), Units 1 and 2, license renewal application (LRA).

RAI# B.2.16-3 In LRA Section B.2.16, the applicant stated that the frequency of functional testing for the BVPS Halon and carbon dioxide (CO2) systems will be at least once every 18 months, which is less frequent than the NUREG-1801, XI.M26 guideline of at least one test every 6 months for the detection of aging degradation. This is an exception to the generic aging lessons learned (GALL) aging management program (AMP) XI.M26. The staff reviewed the BVPS updated final safety analysis report (UFSAR) Section 9.10.4 for Unit 1, and Section 9.5.1.7.4 for Unit 2, C02 and Halon systems. The UFSAR only states that in-service inspection and testing will be periodically performed and does not provide any frequencies.

Since the current licensing basis (CLB) does not specify any frequency, please provide the bases for using a different frequency than the GALL AMP recommended frequency of once every six months.

Discussion: The applicant indicated that the question is clear. The staff reviewed the applicants response to this RAI, dated July 24, 2008, and noted that the applicant references the applicants administrative procedures; however BVPS did not state what testing frequencies are identified in the administrative procedures. The applicant stated that the testing frequency is 18 months and that operating experience supports that frequency. The staff stated that it is not a question of operating experience, but a question of the CLB. The staff asked was the 18 month frequency in the CLB. The applicant stated that the frequency is governed by an administrative procedure, and that administrative procedures are part of the CLB. The applicant stated that the administrative procedure is, 1/2-ADM-1900, Fire protection Program. The applicant again stated that the administrative procedure was part of the CLB, and the CLB states that the frequency is 18 months. This staff agreed and there are no further questions.

RAI # B.2.16-1 LRA B.2.16, Fire Protection Program, the Exception paragraph states: Previous inspections and testing of the halon and carbon dioxide systems at the 18-month frequency have not identified aging degradation issues...However, to ensure the optimum integrity of the in-scope halon and carbon dioxide systems, each will be inspected at least once every 6 months during the period of extended operation.

Since the above implies that the existing inspection interval is 18 months, please confirm if the program will be enhanced to change this inspection interval to 6 months. If so, please justify why this enhancement has not been identified as an enhancement in LRA Section B 2.16.

Discussion: The applicant indicated that the question is clear. The staff reviewed the applicants response to this RAI dated July 24, 2008, and stated that the enhancement words and commitment are too general and do not specifically state that the Fire Protection Program will be enhanced to change the inspection frequency to once every 6 months. The applicant stated that they will provide added text and a changed Commitment in an amendment and supplemental response to change the frequency to 6 months. The staff agreed and there are no further questions.
