Dear Members of the TSTF:
On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your September 22, 2008, letter requesting a fee waiver under 10 CFR § 170.11(a)(1)(iii) for all fees associated with NRCs review of TSTF-511, Revision 0, Eliminate Working Hour Restrictions from TS 5.2.2. to Support Compliance with 10 CFR Part 26. Your request meets the fee waiver criteria; therefore, I am granting your request, as explained below.
Your fee waiver request states that TSTF-511 is a means of exchanging information between industry organizations and the NRC for the specific purpose of supporting the NRCs generic regulatory improvements or efforts. The NRC staff has reviewed your submittal and concluded that the Traveler will provide a means of exchanging information to support NRCs generic regulatory improvements or effort. Specifically, upon approval of TSTF-511, the NRC staff will use the Traveler to support the revision to 10 CFR Part 26, Subpart I, on managing worker fatigue. Therefore, the review of TSTF-511 meets the provisions of 10 CFR 170.11. Hence, I am able to grant you a fee waiver under the provisions of 10 CFR 170.11(a)(1)(iii).
