On October 20, 2008, counsel for the parties to this enforcement proceeding informed us by e-mail that their settlement discussions, which they had engaged in over nearly a three month period, had proven unsuccessful. They further advised us that they had thereupon begun exploring areas of agreement which could limit the scope of the enforcement hearing and were considering an initial statement of issues for stipulation in an effort to expedite the hearing process. In that regard, counsel for Mr. Geisen was said to have expressed a desire to complete the enforcement hearing by the end of 2008.
Faced with these developments, we informed the parties by e-mail that same evening that we wished to convene, at the earliest opportunity, a one-hour conference call to discuss scheduling. Agreement on a suitable time for the call has since been reached informally.
In accordance with that agreement, this Notice formally convenes a conference call to be held on Thursday, October 23, 2008, at 3:30 P.M.1 As indicated in our earlier e-mail, among the matters to discuss during the call are the following:
(1) the anticipated extent and complexity of any stipulation as to the scope of the issues to be addressed at the hearing; (2) the anticipated length of the hearing, both if a stipulation is reached as to its scope and if one is not reached; (3) the scope and duration of any prehearing discovery that might be needed; (4) the nature and timing of any projected prehearing written filings; (5) the resulting anticipated hearing dates; and (6) the nature and timing of the projected post-hearing written filings.
This information should be helpful in developing a procedure and a schedule for moving forward promptly. The parties are of course welcome to raise other matters they deem appropriate.
