The U.S. Nuclear Regulatory Commission has issued the enclosed Amendment No. 179 to Renewed Facility Operating License NPF-2 and Amendment No. 171 to Renewed Facility Operating License NPF-8 for the Joseph M. Farley Nuclear Plant, Units 1 and 2 (FNP),

Amendment No. 260 to Renewed Facility Operating License DPR-57 and Amendment No. 204 to Renewed Facility Operating License NPF-5 for the Edwin I. Hatch Nuclear Plant, Units 1 and 2 (HNP), and Amendment No. 153 to Facility Operating License NPF-68 and Amendment No. 134 to Facility Operating License NPF-81 for the Vogtle Electric Generating Plant, Units 1 and 2 (VEGP), respectively. The amendments consist of changes to the Technical Specifications (TSs) in response to your application dated June 12, 2008.

The amendments revise the TS requirement for the Plant Manager or the Operations Manager regarding the holding of a Senior Reactor Operator license.

1.0 INTRODUCTION

By application dated June 12, 2008, to the U.S. Nuclear Regulatory Commission (NRC)

(Agencywide Documents and Management System (ADAMS) No. ML081650062), Southern Nuclear Operating Company, Inc. (SNC, the licensee), requested changes to the Technical Specifications (TSs) for the Joseph M. Farley Nuclear Plant, Units 1 and 2 (FNP), the Edwin I.

Hatch Nuclear Plant, Units 1 and 2 (HNP), and the Vogtle Electric Generating Plant, Units 1 and 2 (VEGP). The proposed changes would revise TS Section 5.2, Organization, and TS 5.3 "Unit Staff Qualifications" requirements for the plant manager or the operations manager to hold a senior reactor operator (SRO) license. The proposed revision will provide the licensee the option of requiring the operations manager or at least one of the operations superintendents to hold an SRO license. The current TS do not provide the licensee the option to meet Nuclear Regulatory Commission (NRC) requirements by having the operations superintendent hold an SRO license.

The proposed changes meet the requirements of Title 10 of the Code of Federal Regulations (10 CFR) 50.54(l) and are within the administrative controls category.

2.0 REGULATORY EVALUATION

NRC regulatory requirements related to the content of TS are set forth in 10 CFR, Section 50.36.

This regulation requires that the TS include items in five specific categories. These categories include: 1) safety limits, limiting safety system settings and limiting control settings; 2) limiting conditions for operation; 3) surveillance requirements; 4) design features; and 5) administrative controls.

Specifically, 10 CFR 50.36(d)(5) describes administrative controls as provisions relating to organization and management, procedures, recordkeeping, review and audit, and reporting necessary to assure operation of each facility in a safe manner. Licensees are required by 10 CFR 50.54(l) to designate individuals to be responsible for directing the licensed activities of licensed operators. These individuals shall be licensed as SROs pursuant to10 CFR Part 55.

3.0 TECHNICAL EVALUATION

The modifications to the TS for FNP, HNP and VEGP, provide the licensee with the flexibility to meet the requirements of 10 CFR 50.54(l) by allowing the appointment of operations managers without an SRO license if there is at least one SRO-qualified operations superintendent available to direct the licensed activities of licensed operators. The modifications to TS address the qualifications of the individuals with management authority over licensed individuals.

3.1 TS Section 5.2.2.f The licensee proposes to revise Section 5.2.2.f concerning the operations managers position.

FNP TS currently require the plant manager or the operations manager to hold an SRO License.

Thus, the current TS offer the option to the licensee of either the plant manager or the operations manager holding an SRO license whereas the proposed change would require either the operations manager or an operations superintendent to hold an SRO license. HNP TS currently requires the operations manager to hold an active or inactive SRO license. The proposed change for HNP would allow, as an alternative, any of the operations superintendents to hold a SRO license. The operations superintendents that have an SRO license at FNP and HNP will be qualified to American National Standards Institute (ANSI) N18.1 - 1971, Selection and Training of Nuclear Power Plant Personnel. VEGP TS currently require the operations manager to hold an SRO license. The proposed changes for VEGP TS would require the operations manager or at least one of the operations superintendents to hold an SRO license. The operations superintendents that have an SRO license at VEGP will be qualified to Regulatory Guide 1.8, Revision 2, Qualification and Training of Personnel for Nuclear Power Plants. In the event that the operations manager does not hold an SRO license, the proposed changes to the TS for FNP, HNP and VEGP would require at least one of the operations superintendents to hold an SRO license.

3.2 TS Section 5.3.1 The licensee proposes to revise Section 5.3.1 concerning the minimum qualifications for operations managers. The management structures at FNP, HNP and VEGP are each comprised of the operations manager and three operations superintendents. To meet all the requirements of 10 CFR 50.54(l), the operations superintendents that hold an SRO license would have the same management authority over licensed operators as the operations manager and would be responsible for directing the activities of licensed operators. To maintain consistency between TS 5.2.2.f and TS 5.3.1, the licensee proposes adding wording to TS 5.3.1 that would clarify the requirements for which individuals are required to hold an SRO license. Currently TS 5.3.1 for FNP, and HNP require that all members of the unit staff shall meet or exceed the minimum qualifications of ANSI N18.1-1971, which requires the operations manager to hold an SRO license at the time of appointment. Currently TS 5.3.1 for VEGP requires each member of the unit staff to meet or exceed the requirements of Regulatory Guide 1.8, Revision 2. This guidance invokes ANSI/ANS 3.1 - 1981, which requires the operations manager to obtain and hold an SRO license.

The proposed amendment to TS 5.3.1 would not require the operations manager to meet the applicable ANSI standard with regards to holding an SRO license and would refer to TS 5.2.2.f to determine which individuals would be required to hold an SRO license.

The NRC staff finds the proposed change acceptable because the change to TS 5.2.2.f retains the requirements in 10 CFR 50.54(l) by requiring the operations superintendent to hold an SRO license in the case that the operations manager does not hold an SRO license. The proposed changes to TS 5.3.1 prevent an inconsistency between the requirements for holding an SRO.

SNC fulfills this by requiring the operations manager or an operations superintendent to hold an SRO license.

4.0 STATE CONSULTATION

In accordance with the Commission's regulations, the Alabama and Georgia State officials were notified of the proposed issuance of the amendment. The State officials had no comments.

5.0 ENVIRONMENTAL CONSIDERATION

The amendment relates to changes in recordkeeping, reporting or administrative procedures or requirements. The Commission has previously issued a proposed finding that the amendments involve no significant hazards consideration, and there has been no public comment on such finding (73 FR 37505, dated July 1, 2008). Accordingly, the amendments meet the eligibility criteria for categorical exclusion set forth in 10 CFR 51.22(c)(10). Pursuant to 10 CFR 51.22(b) no environmental impact statement or environmental assessment need be prepared in connection with the issuance of the amendments.

6.0 CONCLUSION

The Commission has concluded, based on the considerations discussed above, that: (1) there is reasonable assurance that the health and safety of the public will not be endangered by operation in the proposed manner, (2) such activities will be conducted in compliance with the Commission's regulations, and (3) the issuance of the amendments will not be inimical to the common defense and security or to the health and safety of the public.
