KEWAUNEE POWER STATION; MILLSTONE POWER STATION, UNIT NOS. 1, 2, AND 3; NORTH ANNA POWER STATION, UNIT NOS. 1 AND 2; AND SURRY POWER STATION, UNIT NOS. 1 AND 2 - ACCEPTANCE OF REQUESTED LICENSING ACTION RE: THE USE OF WEIGHTING FACTORS FOR EXTERNAL EXPOSURE (TAC NOS. MD9472, MD9708, MD9473, MD9474, MD9475, MD9476, MD9477, AND MD9478)

Dear Mr. Christian:

By letter dated August 18, 2008 (Agencywide Document and Management System (ADAMS)

Accession No. ML082321198), as supplemented by letter dated September 22, 2008 (ADAMS Accession No. ML082670295), Dominion Energy Kewaunee, Inc., Dominion Nuclear Connecticut, Inc., and Virginia Electric and Power Company, submitted an application for Kewaunee Power Station; Millstone Power Station, Unit Nos. 1, 2, and 3; North Anna Power Station, Unit Nos. 1 and 2; and Surry Power Station, Unit Nos. 1 and 2. The proposed request would allow the use of weighting factors for calculating external whole body dose. The purpose of this letter is to provide the results of the U.S. Nuclear Regulatory Commission (NRC) staff=s acceptance review of this request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

Section 20.1003 of Title 10 of the Code of Federal Regulations (10 CFR) states, for the purpose of weighting the external whole body dose (for adding it to the internal dose), a single weighting factor, Wt = 1.0, has been specified. The use of other weighting factors for external exposure will be approved on a case-by-case basis until such time as specific guidance is issued.

Section 20.1201(c) of 10 CFR addresses the technical information of how individual dose is determined.

The NRC staff has reviewed your application and concluded that it does provide technical information in sufficient detail to enable the NRC staff to proceed with its detailed technical review and make an independent assessment regarding the acceptability of the proposed amendment in terms of regulatory requirements and the protection of public health and safety and the environment. If additional information is needed for the NRC staff to complete its technical review, you will be advised by separate correspondence.
