MEMORANDUM AND ORDER (Scheduling Oral Argument)

On Friday, September 5, 2008, at 1:00 PM, this Board convened a conference call with counsel to the parties to discuss procedural and administrative matters relating to an upcoming oral argument. After considering the concerns raised by counsel, the Board has determined that the following schedule will best accommodate the interests of the parties and the concerned stake-holders, while promoting the agencys interest in an expeditious resolution of the issue referred to the Board in the Commissions August 21, 2008 order:1 Date: Thursday, September 18, 2008 Time: 9:00 AM Eastern Time Location: Ocean County Administration Building Room 119 101 Hooper Avenue Toms River, NJ 08754 1

The Board anticipates that argument will be completed within a few hours, and prior to breaking for lunch.2 We will promptly provide the parties with more specific procedural details regarding argument - e.g., allotted time for opening statements and closing statements (including any specific issues to be addressed), order of presentation, etc.

Additionally, as discussed during the conference call, we will promptly provide counsel with those substantive areas that will be the focus of the Boards questioning at argument.
