MID-CYCLE PERFORMANCE REVIEW AND INSPECTION PLAN -

VIRGIL C. SUMMER NUCLEAR STATION

Dear Mr. Archie:

On August 14, 2008, the NRC staff completed its performance review of Virgil C. Summer Nuclear Station for the first half of the calendar year 2008 assessment cycle. Our technical staff reviewed performance indicators (PIs) for the most recent quarter and inspection results over the previous twelve months. The purpose of this letter is to inform you of our assessment of your safety performance during this period and our plans for future inspections at your facility.

This performance review and enclosed inspection plan do not include security information. A separate letter designated and marked as "Official Use Only--Security-Related Information" will include the Physical Protection/Security cornerstone review and resultant inspection plan.

Plant performance for the most recent quarter at Virgil C. Summer Nuclear Station was within the Licensee Response column of the NRC=s Action Matrix, based on all inspection findings being classified as having very low safety significance (Green) and all PIs indicating performance at a level requiring no additional NRC oversight (Green). Therefore, we plan to conduct reactor oversight process (ROP) baseline inspections at your facility. We also plan on conducting several non-ROP inspections which include: TI 2515/173, Review of the Implementation of the Industry Ground Water Protection Voluntary Initiative; TI 2515/175 Emergency Response Organization, Drill/Exercise Performance Indicator, Program Review; and TI 2515/176 Emergency Diesel Generator Technical Specification Surveillance Requirements Regarding Endurance and Margin Testing.

Additionally, on October 12, 2007 the staff issued a severity level III Notice of Violation in accordance with the NRC=s Enforcement Policy. This violation was for emergency action level (EAL) changes which resulted in decreases in effectiveness and a non-standard EAL scheme.

The inspectors reviewed the corrective actions described by the licensee in its correspondence dated November 12, 2007 entitled, Reply to a Notice of Violation: EA-07-079 NRC Inspection Report 2007502 and held interviews with appropriate personnel. Immediate corrective actions have been implemented and the long-term corrective action to prevent recurrence of converting to an EAL scheme based on NEI-99-01, Methodology for Development of Emergency Actions Levels Revision 4, has a projected completion date of October 2008. NRC staff determined that the long-term corrective action to prevent recurrence did not need to be completed prior to closing this violation. This violation was closed in integrated inspection report
