PRAIRIE ISLAND NUCLEAR GENERATING STATION - ORDER APPROVING TRANSFER OF LICENSED OPERATING AUTHORITY AND CONFORMING AMENDMENT (TAC NOS. MD8524, MD8525, AND L24245)

Dear Messrs. Wilks and Koehl:

By letter to the U.S. Nuclear Regulatory Commission (NRC) dated April 16, 2008, as supplemented by letter dated August 6, 2008, you submitted an application, pursuant to Sections 50.80 and 50.90 of Title 10 of the Code of Federal Regulations (10 CFR), requesting among other things, approval of the transfer of the operating authority of Facility Operating License No. DPR-42 and DPR-60 for Prairie Island Nuclear Generating Plant (PINGP), Units 1 and 2, and of Materials License No. SNM-2506 for the PINGP Independent Spent Fuel Storage Facility, from Nuclear Management Company, LLC (NMC) to Northern States Power Company, a Minnesota corporation (NSPM). The application also requested approval of conforming amendments to the licenses pursuant to 10 CFR 50.80 and 50.90. Notice of the application was published in the Federal Register on June 5, 2008 (73 FR 32055). The August 6, 2008, letter, contained clarifying information, did not expand the application beyond the scope of the notice, and did not affect the applicability of the no significant hazards consideration determination as published in the Federal Register.

The NRC staff has completed its review of the application and found the proposed transfer of operating authority acceptable. Enclosure 1 is the Order, which approves the proposed transfer of operating authority. Enclosure 2 contains the draft conforming amendments with draft revised pages of the licenses; these amendments will be issued and become effective at the time the transfer is consummated. Enclosure 3 is the NRC staff=s safety evaluation related to the subject actions.
