Oyster Creek License Renewal Message: The staff completed the review of AmerGens application for license renewal of Oyster Creek Generating Station (OCGS).

1.

On January 3, 2008, the New Jersey Department of Environmental Protection (NJDEP) provided AmerGen a letter dated December 28, 2007, that certifies that continued operation of the Oyster Creek plant beyond 2009 was consistent with the environmental safeguards contained in the federal Coastal Zone Management Act. This certification is required for license renewal.

The State of New Jersey has permitting authority over the plants water permits, and has voiced concern over the plants current once-through cooling system.

Status:

The NRC staff received AmerGens application on July 22, 2005.

The current license for OCGS expires at midnight on April 9, 2009, however OCGS was granted an exemption which will allow them to continue operations until a final decision is reached on renewal.

The ASLB ruled in favor of AmerGen on a contention regarding drywell corrosion filed by a group collectively known as Citizens, this group has filed an appeal with the Commission to ask them to overturn the ASLB Decision. Commission Decision is pending.

On May 28, 2008, the Commission requested briefs from all parties on the structural analysis AmerGen committed to perform. These briefs were requested by the Commission in response to concerns raised by Judge Baratta, ASLB.

Additional contention filed on April18 by same group concerning Metal Fatigue and the use of the Fatigue Pro system for evaluating fatigue. Commission sent to ASLB.

Based on a recent Regulatory Issue Summary on Metal Fatigue, the staff is going to issue a supplement to the SER. ASLB is considering the metal fatigue issues.

Motion to Stay filed by Citizens was denied by Commission on June 17, 2008.

The State of New Jersey has appealed the ASLB and Commission decision to deny their contentions regarding terrorist attacks.
