ADDITION OF LIMITING CONDITION FOR OPERATION 3.0.8 ON INOPERABILITY OF SNUBBERS (TAC NO. MD7330)

Dear Mr. Edington:

On May 31, 2008, the U.S. Nuclear Regulatory Commission (NRC) issued Amendment No. 170 to Facility Operating License No. NPF-41, Amendment No. 170 to Facility Operating License No. NPF-51, and Amendment No. 170 to Facility Operating License No. NPF-74 for the Palo Verde Nuclear Generating Station (Palo Verde), Units 1, 2, and 3, respectively. The amendments consisted of changes to the facility operating licenses and the Technical Specifications (TSs) in response to your application dated November 14, 2007. [Note:

Amendment Nos. 169 and 169 for Units 1 and 3 will never be used in order to maintain common amendment numbering, as requested by your staff.]

The amendments modified the TS by adding Limiting Condition for Operation (LCO) 3.0.8 on the inoperability of snubbers using the Consolidated Line Item Improvement Process. The amendments also made conforming changes to TS LCO 3.0.1. These amendments were approved consistent with the NRC-approved Industry/Technical Specification Task Force (TSTF)

Traveler No. 372, Revision 4, Addition of LCO 3.0.8, Inoperability of Snubbers.

The revised page 4 of the facility operating license for Palo Verde Unit 3 inadvertently omitted Section 2.C(6)(a) from the license. This administrative error only affected page 4 of the Unit 3 license and did not impact the Amendment No. 170 for Unit 1 or Amendment No. 170 for Unit 2.

The omission does not change the staffs conclusions regarding Amendment No. 170 for all three Palo Verde units. Enclosed is a corrected version of page 4 to the Unit 3 facility operating license that restores Section 2.C(6)(a). Please discard the associated page from the previous amendment and replace it with the enclosed page.

Maximum Power Level Arizona Public Service Company (APS) is authorized to operate the facility at reactor core power levels not in excess of 3876 megawatts thermal (100% power) through operating cycle 13, and 3990 megawatts thermal (100% power) after operating cycle 13, in accordance with the conditions specified herein.

Technical Specifications and Environmental Protection Plan The Technical Specifications contained in Appendix A, as revised through Amendment No. 170, and the Environmental Protection Plan contained in Appendix B, are hereby incorporated into this license. APS shall operate the facility in accordance with the Technical Specifications and the Environmental Protection Plan, except where otherwise stated in specific license conditions.

Antitrust Conditions This license is subject to the antitrust conditions delineated in Appendix C to this license.

Mitigation Strategy License Condition APS shall develop and maintain strategies for addressing large fires and explosions and that include the following key areas:

Assessment of mutual aid fire fighting assets.

3.

Designated staging areas for equipment and materials.

4.

Command and control.

5.

Training of response personnel.
