Dear Mr. Polson:

By letter dated December 14, 2007, Nine Mile Point Nuclear Station, LLC submitted for Nuclear Regulatory Commission (NRC) staff review and approval, relief request 2ISI-007, proposed alternative in accordance with paragraph 50.55a(a)(3)(i) of Title 10 of the Code of Federal Regulations for the third inservice inspection interval for Nine Mile Point Nuclear Station, Unit 2.

The NRC staff has reviewed the information provided in that letter and has determined that additional information is needed to complete its review. Enclosed is the staffs request for additional information (RAI). The RAI was discussed with your staff on May 15, 2008, and it was agreed that your response would be provided by June 30, 2008.

REQUEST FOR ADDITIONAL INFORMATION NINE MILE POINT NUCLEAR STATION, UNIT NO. 2 (NMP2)

THIRD 10-YEAR INTERVAL RISK INFORMED RELIEF REQUEST 2ISI-007 DOCKET NO. 50-410 The Nuclear Regulatory Commission (NRC) staff has reviewed the Nine Mile Point Nuclear Station submittal dated December 14, 2007, related to a relief request associated with the third inservice inspection interval for NMP2. The submittal requests relief from the American Society for Mechanical Engineers Boiler and Pressure Vessel Code (ASME Code),Section XI, requirements for the selection and examination of ASME Code Class 1, Examination Category B-F and B-J, Class 2 Examination Categories C-F-1 and C-F-2, and IGSCC Examination Category A piping welds. The NRC staff has determined that additional information requested below will be needed to complete its review.

1. Per Regulatory Guide 1.193, Revision 2 dated October 2007, Code Case N-578-1 is listed as an unacceptable Section XI Code Case. Please provide a justification for the application of Code Case N-578-1.
2. The number of welds selected for the nondestructive examination for the third interval has changed with an overall reduction in the number selected, especially for the reactor vessel nozzle. Please clarify/provide an explanation for these changes.
