VIRGIL C. SUMMER NUCLEAR STATION, UNIT 1 - CORRECTION TO EXEMPTIONS ISSUED ON MARCH 13, 2008, FROM THE REQUIREMENTS OF 10 CFR PART 50, SECTIONS 50.44, 50.46, AND APPENDIX K (TAC NO. MD5699)

Dear Mr. Archie:

On March 13, 2008, the Nuclear Regulatory Commission (NRC) approved exemptions from specific requirements of Title 10 of the Code of Federal Regulations (10 CFR), Part 50, Section 50.46, Acceptance criteria for emergency core cooling systems for light-water nuclear power reactors, and Appendix K, ECCS Evaluation Models, for the Virgil C. Summer Nuclear Station, Unit 1 (Agencywide Document Access Management System (ADAMS) Accession No. ML080070466). The exemptions would allow one lead test fuel assembly (LTA) containing fuel rods that are all clad with Optimized ZIRLOTM cladding or one LTA containing both Optimized ZIRLOTM and AXIOMTM fuel rod cladding to continue to be irradiated up to a burnup of 75 GigaWatt days per Metric Ton Uranium.

On page 6 of the Exemption, in the discussion of the fuel pool decontamination factor (DF) used in the fuel handling accident (FHA) analysis, we wish to correct the following statement:

"Because of these controls, the NRC staff is confident that the overall effective decontamination factor will not increase above 200." to read "Because of these controls, the NRC staff is confident that the overall effective decontamination factor of 200 is applicable." This confirms that the significance of the DFs is that they be confirmed to be a specified value, so that value may be used in the FHA dose analysis. We apologize for any inconvenience this may have caused your staff.
