McGuire Nuclear Station (McGuire), Units 1 and 2 Docket Nos. 50-369 and 50-370 Schedule for Submittal of License Amendment Request (LAR) to Adopt 10 CFR 50.48(c) (NFPA 805 Rule)

By letter dated April 18, 2006, Duke informed you of the start of the transition to NFPA 805 (Performance-Based Standard for Fire Protection for Light Water Reactor Generating Plants, 2001 Edition) in accordance with 10 CFR 50.48(c) for McGuire. In that letter, Duke also informed you of the expected transition period of three years and the expected submittal of a LAR prior to December 31, 2008 for McGuire.

By letter dated June 7, 2006, Duke informed you that it expected to bring the Hemyc issue into full compliance with the licensing basis through the transition to NFPA 805 process. That letter also referenced the December 31, 2008 date for the LAR submittal.

By letter dated September 26, 2006, you approved the three-year transition period for McGuire.

In that letter, you also specified the transition discretion period for McGuire to be from April 18, 2006 to April 18, 2009.

This letter informs you that Duke plans to utilize the full three-year transition discretion period as specified in your September 26, 2006 letter. As such, Duke is revising its schedule for the LAR submittal to April 18, 2009.
