Dear Mr. Nelson:
This letter is in response to your email addressed to the Office of the Secretary of the Nuclear Regulatory Commission (NRC), dated February 24, 2008, in which you stated I am filing a 2.206 regarding the Indian River Plant. Your email was referred to the Office of Nuclear Reactor Regulation (NRR) for consideration pursuant to Title 10 of the Code of Federal Regulations (10 CFR) Section 2.206.
NRR has found that your request does not meet the criteria for consideration under 10 CFR 2.206, because it does not contain a request for enforcement-related action against a licensee of the NRC. In all proceedings, the NRC does strive to be fair and impartial to both licensees and other stakeholders. This is reflected in the values stated in our strategic plan: The safe use of radioactive materials and nuclear fuels for beneficial civilian purposes is enabled by the agencys adherence to the principles of good regulation - independence, openness, efficiency, clarity, and reliability.
