COMANCHE PEAK STEAM ELECTRIC STATION, UNITS 1 AND 2 - REVISION TO THE EMERGENCY PLAN TO CHANGE NORTHERN BOUNDARY OF THE PRESENT EMERGENCY PLANNING ZONE (TAC NOS. MD6063 AND MD6064)
Dear Mr. Blevins:
By letter dated July 13, 2007, and supplemented by letter dated October 25, 2007, TXU Generation Company LP (subsequently renamed Luminant Generation Company LLC),
requested U.S. Nuclear Regulatory Commission (NRC) approval for changes to the Emergency Plan (EP) for the Comanche Peak Steam Electric Station (CPSES), Units 1 and 2.
The changes to the CPSES EP are based upon a proposed revision of the northern boundary of its present Emergency Planning Zone (EPZ). The purpose of the revision is to clearly define the northern boundary of its EPZ within the City of Granbury.
The NRC staff has completed a technical and regulatory review of the proposed changes and supporting documentation. We have concluded that incorporation of the proposed changes do not decrease the effectiveness of the CPSES, Units 1 and 2, EP and the plan, as changed, continues to meet the standards of Section 50.47(b) and the requirements of Appendix E to Title 10 of the Code of Federal Regulations (10 CFR) Part 50. In light of the above, no NRC approval is necessary. The basis for our conclusion is discussed below.
The CPSES, Units 1 and 2, EPZ is divided into 22.5-degree sectors and concentric circles of 1-mile increments within a 10-mile radius of CPSES, Units 1 and 2. The current CPSES, Units 1 and 2, EP has the entire City of Granbury within its EPZ. Over the years, the City of Granbury has expanded beyond what was originally approved by the NRC and Federal Emergency Management Agency (FEMA). The proposed revision to the CPSES, Units 1 and 2, EP is to redefine the northern boundary of the EPZ to state Granbury south of Pearl Street.
The application stated that this proposed revision to the CPSES, Units 1 and 2, EP was considered by the licensee and its offsite planning partners to be an improvement to the current CPSES, Units 1 and 2, EP. In the State of Texas, the decision making for protective actions is performed at the local, rather than state, level. The State of Texas has been briefed on this

proposed change and is in agreement with the local government. The NRC staff asked for documentation related to FEMAs concurrence with this proposed change to the CPSES, Units 1 and 2, EPZ. This documentation was provided by the licensee in their letter dated October 25, 2007.
The NRC staff also requested additional information related to any expected changes to the licensees Alert and Notification System. The licensee stated that no changes will be made to the CPSES, Units 1 and 2, Alert and Notification System based upon this proposed revision to the EP.
