In the referenced letter to the NRC dated December 7, 2006, Duke proposed amendments to revise the McGuire and Catawba Facility Operating Licenses (FOL) and Technical Specifications (TS) to allow a period of time both trains of Control Room Area Ventilation System (CRAVS) and Control Room Area Chilled Water System (CRACWS) are allowed to be inoperable before TS Limiting Condition for Operation (LCO) 3.0.3 is required to be entered. In consultation with members of your staff regarding this amendment request, it was noted that McGuire is in the process of developing an amendment to TS 3.7.9 related to control room envelope habitability (Technical Specification Task 'Force (TSTF)

Standard Technical Specification (STS) change TSTF-448 Revision 3).

As a result, it was agreed that for efficiencies of both Duke and the NRC, Duke would withdraw the referenced amendments for both McGuire Nuclear Station (MNS) and Catawba Nuclear Station (CNS) to allow for a more efficient review of the control room envelope habitability request.

U. S. Nuclear Regulatory Commission November 15, 2007 Page 2 The December 2006 submittal to the NRC was to satisfy a commitment made in the referenced letter dated December 1, 2005 and updated in the referenced letter dated March 7, 2006.

In addition to retracting the proposed amendments associated with the commitments in the December 1, 2005 and March 7, 2006 referenced letters, Duke is also revising the commitmenit to be MNS specific and apply to Control Room Area Ventilation and Control Room Area Chilled Water Systems only. The commitment will be changed in the McGuire corrective action process to read:

"Address the operability requirements for the CRAVS and CRACWS 0n a shutdown unit when this equipment is relied on to support the operating unit in Modes 1 through 4.'

Although the commitment is revised to be applicable to McGuire only, the final proposed amendments may be submitted for both McGuire and Catawba, as applicable.

As stated above and discussed with your staff, McGuire is in the process of developing an amendment to TS 3.7..9 related to control room envelope habitability. McGuire will reevaluate the proposed.CRAVS and CRACWS amendments following implementation of Technical Specification Task Force (TSTF) Standard Technical Specification (STS) change TSTF-448 Revision 3 and re-submit the amendments following NRC approval of the amendment to TS 3.7.9, as applicable.

Pursuant to 10 CFR 50.91, a copy Of this LAR withdrawal is being sent to the designated official of the states of North Carolina and South Carolina.
