Dear Mr. Hug:

By letter dated September 19, 2007 (ADAMS Accession No. ML073330646), NEI submitted NEI 99-01, Revision 5, AMethodology for the Development of Emergency Action Levels@

(ADAMS Accession No. ML073330643), to the NRC for review. We would like to thank NEI and the industry for their efforts in drafting this proposed revision to NEI 99-01.

NEI 99-01, Revision 5, is intended to capture lessons-learned since the implementation of NEI 99-01, Revision 4, as well as security-related emergency action levels (EALs) modified via NRC Bulletin 2005-02 and other EALs modified during the EAL Frequently Asked Questions process.

The NRC has performed a technical review of the proposed revision to NEI 99-01 and has marked up the document. The NRC is providing you with this marked up version of NEI 99-01, Revision 5, dated December 2007 (ADAMS Accession No. ML073320434). As this is an NEI document, please provide documentation that the NEI/Industry EAL Task Force has reviewed the document and request formal endorsement by the NRC, or provide a revision to the document for NRC review.

Again, we would like to thank NEI for drafting this document and for leading the effort to develop a guidance document to assist the industry in the development of EALs.
