CHANGE CONTROL AND REPORTING RELATED TO OFFSITE DOSE CALCULATION MANUAL

Dear Mr. Bell:

By your letter dated September 11, 2007, the Nuclear Energy Institute (NEI) submitted the generic program description NEI 07-09, Generic Final Safety Analysis Report (FSAR) Template Guidance for Offsite Dose Calculation Manual (ODCM) Program Description. The report and related review by the U. S. Nuclear Regulatory Commission (NRC) staff has been discussed at several public meetings. A question arose at the public meetings regarding change control and reporting requirements for the ODCM following the issuance of a combined license (COL) and whether a COL holder (licensee) would be required to obtain a license amendment in order to change the site-specific information contained in the ODCM program description provided with its COL application. Specifically, the issue was whether changes to the site-specific information provided in the ODCM program description, which occur after issuance of a COL, but prior to implementation of the full ODCM program, would require a license amendment.

As discussed during the public meetings, such changes would not, necessarily, require a license amendment. The ODCM program description provided in NEI 07-09 is designed to serve as a generic program description for use in developing COL applications. This program description is required to be included in a COL applicants FSAR per Section 52.79, Contents of applications; technical information in final safety analysis report, of Title 10 of the Code of Federal Regulations (10 CFR 52.79). Changes to FSAR-level information by a licensee after issuance of a COL are addressed in 10 CFR 52.98, Finality of combined licenses; information requests. Specifically, 10 CFR 52.98(b) states that, in situations where a COL does not reference a design certification or a reactor manufactured pursuant to a Subpart F manufacturing license, changes in the facility and procedures described in the FSAR are controlled by the applicable change processes in 10 CFR Part 50. In situations where a COL references a certified design, the Part 50 change processes apply to changes that are not within the scope of the referenced design certification rule, unless such changes also involve changes to or noncompliance with information within the scope of the referenced design certification rule. Likewise, in situations where a COL references a reactor manufactured under a Subpart F, the Part 50 change processes apply to changes that are not within the scope of the manufactured reactors design.

Bell In the case of changes to site-specific information provided in the ODCM program description that do not affect information within the scope of a design certification rule or Subpart F manufacturing license, as described above, the applicable Part 50 change process would be the process described in 10 CFR 50.59, Changes, tests, and experiments. The results of the 10 CFR 50.59 analysis will dictate whether the licensee is required to obtain a license amendment prior to implementing the proposed change, in accordance with 10 CFR 50.90, Application for amendment of license or construction permit.

A related question that arose during the public meetings was whether the license condition described on page six of SECY-05-0197, Review of Operational Programs in a Combined License Application and Generic Emergency Planning Inspections, Tests, Analyses, and Acceptance Criteria, (ADAMS Accession Number ML052770257) would function to require a license amendment to modify the ODCM program description contained in a COL holders FSAR. As discussed during the public meeting held on September 20, 2007, and explained in SECY-05-0197, the purpose of this implementation condition is to link program implementation directly to the COL. This is necessary because some operational programs, including radiation protection programs like the ODCM, do not have associated regulatory requirements covering implementation. Therefore, this implementation condition functions to provide certainty as to the implementation schedule for a given program, but does not affect the change processes applicable to modifying the information contained in a licensees FSAR.
