Dear Mr. Duncan:
Enclosed for your information is the synopsis of the Nuclear Regulatory Commission (NRC)
Office of Investigations (OI) completed report regarding whether a security officer was discriminated against for engaging in protected activity.
OI determined that there was insufficient evidence to substantiate the allegation that the former Security Officer of Securitas Security Services, Inc., was discriminated against for raising an FFD issue. We plan no further action with regard to this matter. Should you have any questions concerning this letter, please contact us.
In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter and its enclosure will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS). NOT FOR PUBLIC DISCLOSURE WITHOUT APPROVAL OF FIELD OFFICE DIRECTOR, OFFICE OF INVESTIGATIONS, REGION II Official Use Only - OI Investigation Information Case No. 2-2006-033 SYNOPSIS This investigation was initiated by the Nuclear Regulatory Commission (NRC), Office of Investigations (OI), Region II (RII), on August 16, 2006, to determine whether a former Security Officer, Securitas Security Services, Inc. (Securitas), employed at the Shearon Harris Nuclear Plant, was discriminated against for engaging in protected activity. The security officers protected activity was relative to reporting a fitness-for-duty (FFD) issue to Securitas management on July 1, 2006.
Based on the evidence developed during this investigation, OI:RII did not substantiate that the former Security Officer, Securitas Security Services, Inc., was discriminated against for raising an FFD issue.
