Dear Mr. Martinelli:
On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your E-mail correspondence of July 25 (three messages) and August 23, 2007 (one message), and letter dated July 25, 2007, regarding the Indian Point Nuclear Generating Unit Nos. 2 and 3 (Indian Point) license renewal application (LRA). In your correspondence, you requested, among other things, (1) that "all pending actions" regarding the Indian Point LRA review be halted, until you have been provided complete access to documents necessary for you to prepare contentions to request a hearing, (2) that the NRC cancel its scheduled environmental impact scoping meeting on September 19, 2007, because you believe that the NRC's Federal Register (FR) notice (72 FR 45075), dated August 10, 2007, provided incorrect information concerning the ownership and/or control of the Indian Point facility; (3) that the date for filing petitions to intervene and contentions concerning the Indian Point LRA be postponed; (4) that your name and "Green Nuclear Butterfly" be included in the FR notice for acceptance, identifying you as an opponent to the Indian Point LRA, and (5) that a meeting be held to address your concerns regarding the NRC Staff's production of documents sought in several pending requests for information.
In response to your concerns, please be advised as follows. The NRC Staff has initiated its review of the Indian Point LRA, and will continue to conduct that review in accordance with NRC practice. In addition, as you know, the staff held its environmental impact scoping meeting on September 19, 2007, as scheduled, at which you and a large number of other persons presented numerous scoping comments. While the scoping meeting has been held, the time for the submission of written scoping comments remains open until October 12, 2007. With respect to the schedule for submitting petitions, by letters dated September 18, 2007, to members of
Congress, the Commission extended the due date for filing petitions to intervene in the Indian Point license renewal proceeding to November 30, 2007. A notice of this extension will soon be published in the Federal Register.
We have reviewed your other assertions and have determined that no further action with regard to those matters is required. First, regarding the FR notice of August 10, 2007 (72 FR 45075),
we have concluded that it was accurate, as published, and provided adequate public notice concerning the LRA. As stated in the FR notice, Entergy Nuclear Operations, Inc., submitted the LRA, and that company is a des ignated license holder for Indian Point, as stated in Facility Operating Licenses Nos. DPR-26 and DPR-64 (publicly available on the NRC's Agencywide Documents Access and Management System at Accession Nos. ML052720262 and ML052720273, respectively). Second, the August 1, 2007, FR notice of acceptance for the Indian Point LRA did not identify any particular individual party opposed to the LRA, as there is no requirement to do so. However, in our response letter to Friends United for Sustainable Energy (FUSE) dated July 25, 2007, the NRC staff did include you on distribution as a member
of FUSE. Finally, the NRC Staff has in place established procedures for responding to requests for information. Specifically, your requests for information will be considered and responded to in accordance with those procedures.
