Formal Request To Reschedule Sep 19, 2007 Environmental Scoping Meeting To: Nuclear Regulatory Commission:
The NRC's Federal Registry notice, [Federal Register: August 10, 2007 (Volume 72, Number 154)] [ Notices]
[Page 45075-45076] wrongfully/inadequately asserts/claims that Entergy Nuclear Operations, Inc. (Entergy) has submitted an application for renewal of Facility Operating Licenses Nos. DPR-26 and DPR-64 for an additional 20 years of operation at the Indian Point Nuclear Generating Unit Nos.2 and 3. Indian Point is located in Buchanan, NY.
As a point of clarification, it is pointed out here, that the licenses DPR-26 and DPR-64 are not held, nor controlled by Entergy Nuclear Operations, Inc. directly, but are instead owned, held and/or controlled individually and severally by Indian Point 2 LLC and Indian Point 3 LLC. Any stakeholder who is following and/or participating in the license renewal process for IP2 and IP3 would be aware of this, and further would be looking for Federal Registry Notices not under the search Criteria of Entergy Nuclear Operations, Inc. but instead (and properly so) under the search criteria of IP2, IP3, IP2 LLC, IP3 LLC, Indian Point 2 LLC or Indian Point 3 LLC.
In short, the wording of the Federal Registry Notice was/is incomplete and/or inaccurate in presentation and scope. This error and/or omission, be it deliberate or unintentional in nature creates a cloud of confusion and uncertainty as relates to proper notification of members of the host community and the general public.
For this reason, stakeholder Sherwood Martinelli herein respectfully requests that the public meeting scheduled for September 19th in this Federal Registry announcement be canceled and rescheduled. It is imperative that our community be given every fair and equitable chance to participate in the license renewal process. For that to occur, it is imperative that NRC staff properly identify in all official correspondence and Federal Registry publications a true and accurate representation of the facts as relates to the proper identification of their license holders. 1P2 LLC and IP3 LLC are the rightful owners and/or holders the license numbers DPR-26 and DPR-64. To assure and protect citizen stakeholder rights of involvement, it is imperative that September 19th, 2007 Environmental Scoping Meeting be canceled and rescheduled at a later date.
